I think she's using the word 'penised', because rape, by statute, can only be committed with the use of a penis. The police are saying that even if someone has a penis it can still be recorded as a crime committed by a woman if that individual identifies as a woman.

Kenny McAskill has had a rant on self-identifying women with penises committing rape, specifically the Scottish police agreeing to use their chosen gender identification. The absurdity of the world beggars belief.
I expect JKR will get the usual shit storm.
