If the Panel's findings are as reported whereby it says Fitness to Practice is impaired rather than was impaired then surely the sanctions imposed have to reflect that and if they don't one would wonder why.

God. I don't normally get involved with the worst TRAs (I have Prior blocked fir my own sanity)....but I've never wanted to see someone taken down as much as I do with Prior.

I see that tribunal tweets say the panel has retired to make a decision on sanction. I'd be surprised if that was the case.

I suspect they've retired to allow the parties to read the determination on impairment and decide on their submissions on sanction. Those will be heard at 13:30 and a decision made after that.

I may be wrong, but I'd be surprised if there wasn't the opportunity for each side to present more evidence if they wish, and to give their opinion on what the sanction should be.

The possible outcomes are:

  1. No action
  2. The sides to agree undertakings
  3. Conditions for up to three years (@UncleTonyinahotpinkbrandbeanie that could include needing to get a psychiatric report although, as this isn't a health case, I think that's vanishingly unlikely)
  4. Suspension for up to a year
  5. Erasure

@UncleTonyinahotpinkbrandbeanie it can't be undertakings and conditions. The first is a voluntary agreement, the second is imposed.

It's just one thing off that list, not a combination.

It's unlikely to be either, to be honest. There's a good rule of thumb that it's easy to address clinical failings with conditions (go and do training in blah, only do blah under supervision) but really hard to address failings of insight with conditions. For conditions to work, the registrant has to realise they have screwed up and be prepared to work to put it right.

As someone said on a previous page, Harrop's a long way off that station on the remediation journey.

I think the lowest likely outcome is suspension, and I would be astonished if it were not reviewed. I do query if the Vice article might tip it over into erasure territory. I think that's unlikely, but I don't think it's impossible
