I was wondering on the other thread as well… Is there any professional standards for solicitors offering legal advice under their own name? Do they have any accountability?

RMW presents their version of the law through a strongly skewed ideological filter. I wouldn't like someone with that approach to be my legal counsel, whether or not I agreed with the ideology.

I think the lowest likely outcome is suspension, and I would be astonished if it were not reviewed. I do query if the Vice article might tip it over into erasure territory. I think that's unlikely, but I don't think it's impossible.

Whilst erasure is going to be unlikely, it would be ironic if it was the Vice article that tipped the balance, given that Vice quoted him as saying:

"Ultimately, the tribunal will be deciding whether what I've done and what I've said deems me unfit for practice as a doctor. If that's the case, they could give me a warning, or a suspension. The worst thing that they can do is to strike someone off – effectively erasing them from the medical register – but I think the likelihood of that is virtually nil."

@BreadInCaptivity assume he's suspended for 6 months. At approximately the 5 month point there will be a new hearing.

At that point he will have to convince the panel he has addressed any issues and is fit to return to unrestricted practice. The persuasive burden rests with him to prove he is fit, and not with the GMC to prove that he is not.

That panel can choose whether to lift the suspension, suspend him for a further period, or replace the suspension with conditions. (With some regulators that panel can also chose to erase him, but I don't know if the MPTS panel has that available or not.)

It's not 'six months suspension and then it's over'. It's 'six months suspension and then we'll reassess'.

That's assuming they a. suspend and b. order a review, which is clearly an unknown at this point.

Anyone else might blush but I see RMW was emboldened enough to return to FWR yesterday to deliver the usual reprimands and reproaches.

tbh, I've seen sufficient of RMWs posts here to have formed a view of whether or not I'd use a 'skip' button if MNHQ ever implemented one. Life is too short to waste on items of low value.

Thanks @BreadInCaptivity, I've read it all properly now I can see what you mean about how clearly it spells out there thinking. Amazing how generous they've been although you can see they've applied the absolute letter of the law, it feels he got away with a lot on technicalities!

Interesting that there are very senior medical people in the list of witnesses who have articulated their concern - referring him to this process was a matter of integrity for them. That has to hold some weight?!

Also really hard to understand how AH could possibly say he was unaware re guidance when his supervisor so clearly states he discussed it all with him.
