FairFriday we don’t know the date of the offence. We know she was 5 at the time and he is 21 now. Could have been 10 years ago, could be last year. We don’t know enough really. Still worth writing in, as suggested above, in case there isn’t any exceptional back story and the Judge has, to put it mildly, lost the plot.

@Cattenberg - mental capacity to stand trial, yes; and mental capacity that he had the intention to commit the rape. But enough of a mental disorder to count as a powerful and exceptional mitigation factor

I have commuted on the train in the same carriage with this man several times. Mentally he does not have full capacity.

He takes his toys with him to play on the train and talks to himself.

I've googled and as far as I can see, three news outlets are covering this - Mail, Mirror and local paper. The wording appears to be almost identical in all of them, so I assume they're all getting their copy off the same syndicated news feed.

If he has reduced culpability for whatever reason, surely he should be detained somewhere secure for the safety of other children?

It’s disgusting. Rape of anyone of any age used to have a determined minimum sentence . Surely the rape of a defenceless young child is the reason for an even stronger sentence .

I work in the CJS and am increasingly seeing community service being dished out for worse and worse offences. I am in despair at it all tbh. I used to feel I was doing some good in the world, now I just feel ashamed. That poor family, I really have no words.

I wanted to post this, not because I agree with what has happened, and I most certainly don't and I have posted this on Facebook to ask my friends and family to write to the Attorney General.

BUT what if this 21 year old has no idea he has done wrong? Does he have a mental deficiency? Does anyone know? How can he NOT be convicted of Rape if he knew what he was doing was wrong? I think there must be some mental/neurological disorder for the Judge not to convict him.

Agreed. If this is the case then should be in a secure unit, not in society with access to children.

RedDiamond, but a mental or neurological disorder doesn't mean you basically get off. It's why we have secure mental health facilities like broad moor. I don't think anyone would argue that he should not be removed from society in order to protect other children, even if prison isn't the right place.

Caveat: of course we don't know the specific details of this case, so it's very hard to comment.

My heart is breaking for the child and her family. I hope her mother wins an appeal. And I hope that this family get the ongoing support that they need after such a horrific ordeal.

He has been convicted. He was found guilty after a trial.

The issue is the punishment. He needs to pay £2700, will be on the sex offenders register for 5 years (should be life) and has to do community service. For raping a child. It's awful.

Can I just say to everyone that I am absolutely HORRIFIED. I just cannot get my head around a non custodial sentence unless there is something else there. What Judge in their right mind would not give a custodial sentence? And I am sure the Mother of this little girl would have been shouting from the roof tops that the reason there was not custodial sentence was because of other mitigating circumstances. So there cannot be any other mitigating circumstances.

Good God. Even if there are questions over his mental capacity, surely for the safety of other children he should be put in a secure unit? For life? What on earth is wrong with Worcester?

I imagine it was for a historic rape he did as a child himself. I can’t see any self-respecting judge dish this out otherwise.
