How? How??

If anyone knows how I can donate to the mum's bid to challenge his sentence in the High Court please tell me.

@Kantastic

Am slightly baffled by the TW in the OP's title though - can't see relevant reference in the DM article, have they edited it out

TW means "trigger warning" in this case!

I was baffled too - I would suggest the op asks for the title to be amended for clarity.
ErrolTheDragon · 15/10/2020 18:59

Are there any other reports which give any idea why this ludicrous sentence was applied to such an awful crime?

howard97A · 15/10/2020 18:59

This makes me wonder about the judge. Why be so lenient?

I think it’s worth remembering that a judge is not entitled to pass any old sentence that he personally thinks is appropriate. He has to follow the Sentencing Council Guidelines.

Section 174 of the Criminal Justice Act 2003 imposes a duty to give reasons for, and explain the effect of, the sentence. Unfortunately the reasons for this sentence are not reported in this article, but as the the sentence range for this offence is 6 – 19 years custody the circumstances of this case must have been wholly exceptional.

I cant find then judge's comments anywhere. The judge usually gives some remarks explaining their sentence, but I cant find them published anywhere.

Has anyone got a quote?

I can’t find anything g either

Aridane · 15/10/2020 19:07

Thanks, @Kantastic, for expanding what TW meant in this context

DishingOutDone · 15/10/2020 19:07

Oh hang on, I see @20mum is suggesting medical castration. Well, yes, that AND a custodial sentence so that mum can say to her DD "he can't hurt you now".

Justasecondnow · 15/10/2020 19:08

I don’t think we know date of offence do we?

I wonder how old he was at time of offence? If perhaps he was a child and perhaps a victim of sexual abuse himself. A possible circumstance that could account for the exceptionally lenient sentencing. Pretty shocking sentence without some extraordinary back story.

Local FB seems to suggest the criminal has some sort of learning difficulties. Would be helpful to learn more as the sentence is so extremely lenient. IANAL so I’m not clear how this would impact on sentencing- but would assume that if he is capable of rape, capable of giving evidence in a court, then he has the capacity to know right from wrong and to control his own behaviour. So I’m not sure how these alleged learning difficulties would be mitigation.

I am gobsmacked by this sentence and vv angry. I will also write.

SchadenfreudePersonified · 15/10/2020 19:09

@FairFriday

Surely the guidelines must include a custodial element?
You would think so, wouldn't you? Raping a child - though if he was placed in custody, what's the odds it would be a woman's prison?

Bloody disgusting all round.

I'll be writing, too.

Feministschool · 15/10/2020 19:09

To the PP in law who suggested there might be "something else" going on that would reduce sentence that couldn't be reported on, what sort of thing might that thing be? He isn't underage or related to the victim.

Awwlookatmybabyspider · 15/10/2020 19:11

Well the judge is clearly a Paedo lover. Mind you lets not forget they need to keep all the spaces they can to house the poor old soul we can't pay their council tax.
Angry doesn't even begin to cover what I'm feeling right now.
30 years and castration without anaesthetic that's what I'd have gave him. To be honest some may say "Hed be safer in prison. His picture is out there now. I'm not condoning or promoting vigilante attacks but it does go on and nor would I lose any sleep either.
Love to this precious baby and her family. Surely there must be a,petition to sign.

FairFriday · 15/10/2020 19:12

There was a case in Scotland (again a young man) and he was given a slap on the write because... he was going to study to be a vet and a custodial sentence would be Very Sad for him (or some such nonsense).

Justasecondnow · 15/10/2020 19:12

Feministschool he isn’t underage now but these things take a while to get to court. Maybe he was at time of offence. I don’t know.

GabsAlot · 15/10/2020 19:12

and people wonder why there are vigilantes

this is disgusting

lesleyw1953 · 15/10/2020 19:13

We have emailed a protest

FreshFreesias · 15/10/2020 19:14

It’s like Eric Joyce all over again.
The establishment seeks to normalise paedophilia.

FairFriday · 15/10/2020 19:14

Isn’t he 21 now? How long ago was this?

TooManyDogsandChildren · 15/10/2020 19:15

Email sent. So its fine to rape small children now then?

Aridane · 15/10/2020 19:16

This is very odd from a legal perspective in light of the sentencing guidelines for rape of a child under 13 - consult.justice.gov.uk/sentencing-council/victim-is-a-child/supporting_documents/Guidelines_Offences%20where%20the%20victim%20is%20child.pdf

My sense of this is mitigation associated with mental disorder / learning difficulty - though speculation on my part. Mitigation factors for sentencing attached

I have commuted on the train in the same carriage with this man several times. Mentally he does not have full capacity.

He takes his toys with him to play on the train and talks to himself.

Not sure why this isn't in the media.

Aridane · 15/10/2020 19:18

You would think so, wouldn't you? Raping a child - though if he was placed in custody, what's the odds it would be a woman's prison?

Unlikely since he is a man and not a TW

Thanks for the clarification Kantastic and everyone else.
