New Year New Judicial Review? CPS Hate Crime Guidance for schools

If you haven't seen this, I think you should.

www.faircop.org.uk/post/police-must-not-patrol-trans-discussion-in-schools

In brief, the CPS have published guidance about hate crimes in school - but won't let parents see the guidance. Its for teachers only. I've emailed for a copy and so have others. I have a child in the school system. I want to know how serious the risk is that she will be arrested and charged for discussing biology.

I think anyone else who is also worried should email the CPS and ask to see the guidance.

Teachers and schools can download the pack from this website. This is a resource for schools, so a password is required to download the pack. This can be requested by emailing [email protected].

Why have you been asked to hold off Spero?

ThinEndoftheWedge · 28/01/2020 14:34

Spero - thanks I will look out for it.

In the meantime - are you able to provide a short snippet where it states that it will be unacceptable for girls to object to trans girls in their same sex spaces and /if this should be classed by schools as a ‘hate crime’/bullying

Spero · 28/01/2020 15:57

Journalists maybe publishing. I want this to get maximum exposure. One way or another it should all be out by Saturday at latest.

Excellent work! I’ll wait.

Spero · 28/01/2020 15:59

There is apparently a worrying video which I haven't seen basically training girls not to object to others in their space. It's about some scenario in a toilet. Those who have seen it express concerns.

Thanks .I have the old I wanna see the new!

RuffleCrow · 28/01/2020 16:02

Wtf? How can it be legal to make children follow laws they're not allowed to be made aware of? It's a safeguarding nightmare. It's in direct contradiction to most school policies which must be agreed to by child and parent on admission. Wtaf!

RuffleCrow · 28/01/2020 16:05

It looks from p.25 as though girls will be unable to draw boundaries with transgender pupils who may wish to spend time with them without committing a hate crime? Is that right, Spero?!

ThinEndoftheWedge · 28/01/2020 16:09

The right to say no and have autonomy over their own bodies being eroded by government funded charities

Awful awful awful

Spiro - will the press directly point the finger at Stonewall et al? They need to be held accountable for this bullshit

SarahTancredi · 28/01/2020 16:10

Bingo ruffle

Now bear in mind that incidents can be reported by someone outside the situation so if they hear half a conversation or just hear someone being told to go away then if they think its related to sexual orientation or identity theh thats enough.

How is someone meant to prove that they told them to go away cos they were being an arsehole

Aesopfable · 28/01/2020 16:22

Page 25 doesn’t distinguish between crimes and things that are not criminal offences - presumably to make people think they all are.

I notice wearing a ‘woman: adult human female’ T-shirt, or ‘Same sex attracted’ one is included as would be fpfw or transgender trend leaflets or even talking about women’s rights.

SarahTancredi · 28/01/2020 16:37

Also doesnt define the terms . What does reject mean? Can a girl say no to a transgirl when shes a lesbian ?

RuffleCrow · 28/01/2020 16:40

So if FPFW make a t-shirt that says "Lesbian = same sex attracted female" would the school

a) take the part of the girl who has the right to not be harassed for her sexual orientation

or

b) take the part of the male student who feels this amounts to a hate incident towards him on the basis he identifies as transgender?

Hmm... tricky one that. No idea how that would play out in rl. Hmm

Also this guidance clearly conflicts with anti-stalking and anti-harassment legislation. As an adult, i would hope that the law would take action against a male following me around, trying to get into my friendship group, insisting that i 'include him' when i don't want to. Surely being at school doesn't erase girls' protection from those legislations?

Spero · 28/01/2020 17:28

It looks from p.25 as though girls will be unable to draw boundaries with transgender pupils who may wish to spend time with them without committing a hate crime? Is that right, Spero?!

I would say that's putting it a trifle accurately.

OP posts:
Spero · 28/01/2020 17:30

Well to be fair - not necessarily a hate CRIME but a hate INCIDENT

Which is recorded on a piece of paper that says CRIME REPORT and talks about THE VICTIM

And which can be disclosed to your employer at the Chief Constables discretion appaz.

So that's ok then.

OP posts:
Lordfrontpaw · 28/01/2020 17:32

So basically it’s open season for girls? Will schools therefore make a female bodied student change/shower with boys?

SarahTancredi · 28/01/2020 17:38

And the victim diesnt even necessarily have to exist as if they werent offended but the complainant was then they are somehow the victim of this non crime crime

Langbannedforsafeguardingkids · 28/01/2020 17:39

I feel sick reading this thread. What happened to consent?

Apart from anything else, forcing kids, against their will, to spend time with other kids won't solve the problem of kids feeling excluded. Everyone knows when someone is only tolerating their presence.

Michelleoftheresistance · 28/01/2020 17:41

For saying no, (whether for right or wrong reasons irrelevant) at the age of 11, to another 11 year old. (Who may, or may not at the time you apply for a job with your employer 10 years later, still be transgender).

That's sane.

What the hell are the CPS thinking? This makes an absolute laughing stock of the whole service. This seriously does appear to be the wishlist of a few males with significant problems including total lack of empathy, loathing of females etc, apparently waved through without anyone checking it against things like actual law and education policy.

Is there any adult still remaining anywhere in Westminster?

Michelleoftheresistance · 28/01/2020 17:46

Well I never thought 2020 would involve mass strikes in schools by girls and female staff, or massed parents pulling their children out of school.

Not divisive and causing massive, major, public trust destroying, very expensive and very tricky to resolve problems where there were none at all.

Score.

Mockers2020Vision · 28/01/2020 17:48

Will schools therefore make a female bodied student change/shower with boys?

No, but the approved punishment for said is this:

MyVisionsComeFromSoup · 28/01/2020 17:48

so Girl A can say "I wouldn't want to have to change with a boy"" to Child B. Child C overhearing could assume Girl A was referring to a transgirl (who doesn't actually exist) and then report Girl A for a hate non crime, with no crime and no victim?

Imnobody4 · 28/01/2020 17:50

Recruiting to an anti - LBGT hate group or organisation. Do they name them? Does that include the local mosque. Is FPFW a proscribed organisation?
My blood pressure is at a dangerous level

HipTightOnions · 28/01/2020 17:57

Well, I’ve requested the top secret password, as I imagine many of us have, but presumably there’s more to it than that.

So glad to hear you’re on this Spero.
