New Year New Judicial Review? CPS Hate Crime Guidance for schools

Spero · 24/01/2020 22:21

If you haven't seen this, I think you should.

www.faircop.org.uk/post/police-must-not-patrol-trans-discussion-in-schools

In brief, the CPS have published guidance about hate crimes in school - but won't let parents see the guidance. Its for teachers only. I've emailed for a copy and so have others. I have a child in the school system. I want to know how serious the risk is that she will be arrested and charged for discussing biology.

I think anyone else who is also worried should email the CPS and ask to see the guidance.

Teachers and schools can download the pack from this website. This is a resource for schools, so a password is required to download the pack. This can be requested by emailing [email protected].

Well now we know trans trumps disability

Spero · 29/01/2020 22:37

The Telegraph article is woeful. Simply bangs on about toilets. THAT IS NOT THE POINT

I have written a blog here which contains a link to the Safe Schools Alliance template letter.

PLEASE write to the CPS. This is wrong. I hope someone will challenge the guidance BEFORE a 12 year old accepts a caution for a 'hate crime'

Are single sex private schools admitting trans children of the opposite sex yet?

Spero re Proud Trust, this is a South Manchester based young people's organisation.

These resources seem to have mostly been generated in Manchester supported by Tara Hewitt (TELI UCSM), Three cIrcles Fostering (Wilmslow), The Proud Trust (patrons incl prominant TRAs Stephen Whittle & Christine Burns)
www.theproudtrust.org/about-us/our-patrons/

With additional acknowledged support from Mermaids & GIRES.

The Toolkit (publ 2017) seems heavily based on Allsorts Toolkit but has additional content due to the focus being children in care.
aspects of Allsorts Toolkit have been questioned and there are then I believe additional questions to ask of some of the content of this publication

Chronology (from resource)
"In 2014 Jacob Sibley (director, Three Circles Fostering) and Andrew (the LGBT foundation) completed a consultation on the experiences of LGBT people in care. Their findings helped produce a resource
entitled 'Supporting Lesbian, Gay, Bisexual and Trans Young People - Information for Foster Carers’. During May 2016 Three Circles Fostering met with some individuals who highlighted the need for more training and awareness specifically for care professionals in how to support and care for trans young people in care.
From this, Charlotte Andrew (NT&AS), Sage Aalto (Three Circles Fostering), Tara Hewitt (NHS Equalities lead) and Jacob Sibley
(Three Circles Fostering) completed a consultation with The Proud Trust Afternoon Tea group in September 2016 and with care leavers and individuals at the Sparkle event in Manchester July 2016.
A resource titled ‘trans youth in Foster Care- know your rights’ was produced which is hoped to be shared with all young people in care nationwide, this can be viewed at www.lgbtyouthincare.com.

Its very concerning.

R0wantrees · 29/01/2020 23:25

Safe Schools Alliance:
(extract)
"SSA UK and Fair Cop are concerned about some of the content of this guidance:

It creates a hierarchy of rights.
It blurs the distinction between hate crime, which is defined in law, and ‘hate incidents’, which are not.
It seeks to create a fear among children of being criminalised for asserting sex-based rights or discussing biological reality.
It suggests that any child who states a preference for single-sex spaces is committing a hate incident, and possibly a hate crime.
It suggests that wearing slogans or sharing information with others that recognises biological facts may be treated as a hate crime or incident.
It promotes the ideology of political lobby groups Stonewall and Gendered Intelligence, which have no known qualifications to advise on child safeguarding.
We are asking parents, teachers, governors, and anyone else who is concerned about this guidance to write to the CPS to complain" (continues with link to letter template)

Just before the election I wrote to my MP about the EHRC draft guidance and he forwarded onto the Equalities Minister who responded that they had no say in the guidance and to write to the EHRC. I’m happy to write to the CPS but would it also be worthwhile writing again to my MP about this but slant it that unelected bodies are rewriting law set by Parliament through the back door in issuing guidance that goes beyond what was intended e.g College of Policing guidance and now this.

Mind boggling that lawyers came up with this.

R0wantrees · 29/01/2020 23:50

Im sure its always worth writing to MPs

I presume in this instance you could ask that your MP direct an enquiry to Ministers for Education, Safeguarding, Equalities, Attorney General etc

ThinEndoftheWedge · 30/01/2020 07:55

Just before the election I wrote to my MP about the EHRC draft guidance and he forwarded onto the Equalities Minister who responded that they had no say in the guidance and to write to the EHRC

Is this the same EHRC that needed Nic Williams to correct them on their (wrong) interpretation of the Equalities Act. Really worrying.

We all need to contact our MPs, CPS, EHRC etc and before girls are convicted of the hate crime of trying to uphold their legal right to safety, privacy and dignity through same sex provision.

I know we often point the finger at the Lib Dem’s, Labour, the greens, SNP etc - But TORIES - this is being allowed to happen under YOUR watch. They need to be held to account.

The law for single sex provision is still on our side (for now). Don’t let them ignore it. Don’t let me swayed by Stonewall et al.

Lordfrontpaw · 30/01/2020 07:58

Stonewall will - I believe - go. They have overstepped their remit and became something else entirely. They are no longer fit for purpose.

Binterested · 30/01/2020 08:00

Who does oversee the EHRC then? Or do they just make quasi law without any oversight ?

Lordfrontpaw · 30/01/2020 08:01

Interesting how deep they go

Best LGBT inclusive workplaces in the UK are revealed
Universities and institutions in Wales are leading the way.

All since the extra letters joined the gang.

SarahTancredi · 30/01/2020 08:06

All sincethe extra letters joined the gang

see this is what I dont get. People largely dont give a crap if someone is gay.

The law is meant to protect them in the work place for being gay/lesbian/bi/ trans.

I think most people were happy with that werent they? Accepting or at least professional.around their colleagues . They know they cant fire someone for their sexuality etc

The resistance is coming purely from being coerced into a completely false sense of reality and being made to give up your own rights and having to change everything you say think and feel.

Why did they go this far? What did it achieve exactly.

Aesopfable · 30/01/2020 08:10

The parliamentary and health service ombudsman I think.
www.ombudsman.org.uk/

StandWithYou · 30/01/2020 08:24

Thanks - I will write again and raise these issues. Quick glance at the guidance and reading Spiro’s comments is really frightening.

Hope Fair Cop action comes back favourably and soon.

FloatOn · 30/01/2020 14:12

I've written to my MP but he's a known homophobe so any concerns he raises probably wont be taken seriously.
I've read a bit of the CPS document but had to stop, my head is spinning.

Aesopfable · 30/01/2020 16:00

In order to complain to the ombudsman about EHRC you need to have first completed their complaints process and then your complaint has to be referred to the ombudsman by an MP - so your MP may be useful for that Floaton

Langbannedforsafeguardingkids · 30/01/2020 17:28

Have used the safe schools alliance letter to complain direct to CPS and written to my MP about this. It's horrifying. What happened to 'no means no'?

Spero · 01/02/2020 09:27

Had high hopes that at least some journalists would comment sensibly on this but the coverage has been pretty dire - either none of them understand the wider implications of all this or they are under pressure not to make those links.

Please can everyone write to their MP? Request a meeting if you can? We are not sleepwalking into disaster, we are being deliberately herded into it.

Have faith Spero I think it will happen especially when the Fair Cop judgement is released, the Daily Mail article was really good at explaining the Harry case. I think they will link the two together.

MBWalsh · 01/02/2020 17:55

Can anyone send a link to the guidance, or tell me what to say in the email to get it? I'm not sure how to obtain it.

Spero · 01/02/2020 18:08

The guidance is now public - or at least the part that isn't the videos.

Safe Schools Alliance have produced a template letter
