In brief, the CPS have published guidance about hate crimes in school - but won't let parents see the guidance. Its for teachers only. I've emailed for a copy and so have others. I have a child in the school system. I want to know how serious the risk is that she will be arrested and charged for discussing biology.

I think anyone else who is also worried should email the CPS and ask to see the guidance.

Teachers and schools can download the pack from this website. This is a resource for schools, so a password is required to download the pack. This can be requested by emailing [email protected].

Aren't they supposed to be absolutely shit hot on what constitutes a crime? And whether or not it's likely to lead to a conviction?

Datum - I can only assume this represents Stonewall's finest victory to date. They now have their own private militia to enforce their ideology.

They thought no one would notice - just as I had no clue that this guidance existed in 2014! Because I just assumed I could trust our institutions to not be mad.

The only difference I can find between the 2014 version and this one (apart of course from the stunningly shocking fact that parents may not see it) is the primacy now given to LGBT hate as the 'worst kind of hate' and setting up their rights above all others. That may well be something they wanted to Trojan horse in - if so I hope they will agree with me that it backfired spectacularly

Well, quite. The CPS website just says “send us an email to request a password”. We aren’t asked to provide a Teacher Reference Number, for example, and how would the CPS validate this anyway?

This is an interesting quote taken from the filming partner post.
“The CPS does not make or decide the law; that is the remit of parliament and the courts respectively. Now that this new authoritative judgment has clarified this point of law, the CPS will review its position in the judicial review brought by Emily Hunt.”
What is the relationship of these guidelines to actual law, have they gone through parliament and been tested in court. Why are they involved?

It has been developed by the CPS in partnership with a number of organisations, including Stonewall, the National Police Chiefs’ Council, Gendered Intelligence and NASUWT.

Just seen a comment from a MNetter on the other CPS thread that her body camera record of a full blown assault on her was dismissed by CPS as 'his word against hers' and yet they're right behind who says they looked sideways at who and wouldn't play with them.

It's beyond belief. Angry

I can't say I'm surprised about most of those names but NASUWT?

It's so dreadful isn't it? It gives me the rage to see such terrible coercive control, removal of boundaries / dangerous sexist anti women / girl crap being peddled at schools. These are predatory values - and have no place in schools, let alone society.

So when I was a teen and had incredibly short hair - I could have sued the little old ladies (it always was little old ladies) who called me 'son' and got them a criminal record? Can I also now sue anyone who makes a misogynistic or agist comments to/about me? Remember - this person wasn't threatened in any way.

What is going on in the world?

The NASUWT issued a policy briefing paper in 2017 ,'Trans Equality
in Schools and Colleges Advice and Guidance for Teachers and Leaders'

It acknowledges the advisory role that Debbie Hayton played in its development.

IMO there are a number of potential Safeguarding & legal issues within the document.

Teaching union’s guide highlights inappropriate communication'

The NASUWT guide, entitled Trans Equality in Schools and Colleges — Advice and Guidance for Teachers and Leaders, warns that prejudice and bias “remain rife” in society, where Home Office research has found that transgender people may make up 1% of the population — “possibly one teacher and several pupils in each school”.

Guidance, which was developed with help from secondary school teacher Debbie Hayton who has transitioned from male to female, included: “Avoid discriminating between the sexes in the classroom and the staffroom. Is it necessary to separate boys and girls for an activity?” (continues)

Staff were urged to consider not addressing colleagues as “ladies and gentlemen”, for example, and not to divide classes into groups of boys and girls unnecessarily to avoid potential exclusion of trans children.

The Scottish Trans Alliance (STA) said it believed the guide would help tackle the “unacceptable” discrimination, which transgender people experienced in the education sector.

James Morton, STA manager, said: “We know that it is particularly difficult for teachers to come out as transgender due to high levels of prejudice in society . . . Some [of the small number of teachers STA has supported] have been verbally abused and even physically attacked in hate crimes. Most have been subjected to malicious gossip and discrimination in job interviews.” (continues)
