I didn't realise Miranda Yardley was in court today over alleged transphobic harrasment.

At Basildon Magistrates Court where Miranda Yardley is on trial for transphobic Harassment. The prosecution applied for reporting restrictions to prevent the complainant Helen Islan from being named. The judge has not granted them. So Helen Islan can be named.

To show that Helen was a trans parent advocate

and that it might be because of this she was bringing a claim to court, even though she was cis.

MrsBertBibby I imagine that it would relate to Miranda's tweets about Helen's very public positions on trans-related issues vis-a-vis Helen's trans-identified child. Miranda is banned from Twitter I think (unless he has a new account I don't know), but I'm sure Helen has kept lots of screenshots.

I'm more and more confused. Why would anonymity being refused make it difficult for Helen Islan to give evidence? And why is she doing so by video link rather than appearing in court? And is this a private or public case?

So many questions...

I don't quite know if it's kosher to link to Helen's twitter account, so I won't, but I recall that on various occasions Helen brought up things that had happened to her child at school or referenced her child's medication and so on, and Miranda may have replied in robust terms.

Helen's position AFAICT is:

(a) I'm going to pretend nobody knows who I am and I'm going to tweet personal information about my minor trans-identified child
(b) Nobody is allowed to disagree with that if they do it's harassment because my minor trans-identified child is entitled to privacy

Also Miranda has certainly linked Helen's twitter handle to her (very unusual and identifying) surname, however Helen herself did that originally and her surname appear indelibly in print attached to that handle in the Metro before she became a full-time Twitter activist.

Since the Judge referred to her as "your client" I assume it is a private prosecution. Unless it's a civil harassment claim.

I.e.

  1. Helen once set up a twitter using her full (and possibly unique) name and her current twitter handle and tweeted on it a lot, quite happily, and this was referenced and stored online because, yeah.
  2. Helen started to become a 'trans mum' and tweeted about that.
  3. A few months into being a 'trans mum', Helen decided that she wanted to be 'less' identifiable, and removed her surname from her twitter
  4. Helen has complained to MN in the past when her surname has been posted her with her Twitter handle here

It's a public prosecution. Islan lives in Yorkshire, if I recall correctly. so my guess is that to reduce costs to the taxpayer, video linked evidence from a court approved local site, is granted. [Tax payer would have to cover travel and any accommodation costs otherwise.]
