'Unless the practitioner consented, to exclude them from carrying out female-only care would be a breach of section 22 of the Gender Recognition Act 2004, and a criminal office.'

This is what NHS Lothian are claiming- is it true? I thought the Equality Act allowed exemptions and besides, patients are allowed to request same sex practitioners. It's worded in an awful way, almost implying that women are committing a crime if they say no and at the very least not creating an environment where they feel comfortable to do so. It's unacceptable that on being approached for a statement the health trust haven't reassured women that they are entitled to a choice.

Elizabeth Garrett Anderson must be turning in her grave.

“If someone is telling me they’re female, when I can see that they’re male, I’m already thinking the worst. They’re already lying to me. I would leave.”

This is so true, and it is heartbreaking. Women being unable to access vital healthcare because of arsehole men gaslighting us that they are women. And the power structures accepting the arsehole men as women, on their own say-so, and sod what women are saying.

We are still saying No and we will still campaign for keeping men out of women's spaces - especially women's intimate care spaces - but keeping men out of all women-only spaces, really - because otherwise, men just take over.

I thought the Equality Act allowed exemptions and besides, patients are allowed to request same sex practitioners.

100% this. Smear tests, mammograms etc. are carried out for the health & wellbeing of the patient, not for validation of the fucking HCP! It's a proportionate means (to exclude TW from providing intimate treatment) to achieve a legitimate aim (to ensure there are no unnecessary barriers/encourage as many women as possible to seek treatment or attend screening).

It's basic logic & an absolute outrage that any NHS dept fails to consider the impact this absurd trans policy has ON THE WOMEN WHO ARE AT RISK without this treatment/screening.

Bubonic I also highlighted that text to c&p here. NHS Lothian are a fucking disgrace with their misogyny.

FYI this was the group who ran the self exclusion survey a couple of months ago - it was posted on here & went viral.

James Morton, manager of Scottish Trans Alliance, said he recognised that trauma from sexual abuse could mean some individuals required intimate examinations to be carried out by women who were not transgender.

Wow, that's big of him. Hmm

PlectrumElectrum · 18/12/2018 02:14

James Morton, manager of Scottish Trans Alliance, said he recognised that trauma from sexual abuse could mean some individuals required intimate examinations to be carried out by women who were not transgender.

But completely fails to recognise that all women have the right to privacy, dignity & safety, irrespective of their history. So very focused on trans right to privacy & so spectacularly fails to account for anyone else's right to the same.

It also appears STA lied to the census committee last week when they said that a vulnerable person who employs carers would not be put in a position to justify requesting female only carers & yet that's exactly what James Morton is suggesting when they said:

all patients have the right to choose the particular healthcare professional that provides their smear test. This could be done by booking their smear test with a named nurse or GP they know and trust. Alternatively, they could inform the NHS that they require the person not to be transgender and the NHS could then discreetly arrange for a healthcare professional who is known not to be trans to do the smear test.”

That's an awful lot of effort being put onto women to get female only healthcare when asking for female only health care should be the way to access female only healthcare without any further qualification or explanation.

Well congratulations to men, they managed to make women saying "no" a criminal offence.

LittleLebowski · 18/12/2018 06:16

Thanks for the share Badger. Really boils my piss. I want to be informed if my HCP isn't female and have the right to choose one that is. My body, my boundaries, my choice. Sick of this creep in every aspect of women-only space and service provision just to affirm the feelings of a tiny number of men.

heresyandwitchcraft · 18/12/2018 07:05

Thanks to the Times for highlighting this issue, and to you for sharing. What a travesty that females cannot have guaranteed female-only healthcare. James Morton concedes that maybe it’s okay “if you’ve suffered trauma...”
NO! ENOUGH of this bollocks!
Same-sex, female-only provision is a basic right. I do not give a damn about practitioner feelings. Not same-gender. If you do not know what sex means, and that you cannot change sex, then frankly you have no business being a HCP because you’ve failed basic biology.

DisrespectfulAdultFemale · 18/12/2018 07:30

Well put, everyone.

Fuck off, James Morton, and take your woke-bro bullshit with you.

LizzieSiddal · 18/12/2018 07:31

Unless the practitioner consented, to exclude them from carrying out female-only care would be a breach of section 22 of the Gender Recognition Act 2004, and a criminal office

This sums it up for me.
Fuck women’s rights, which are enshrined in Law, trans rights are more important than women’s. And they wonder why we’re angry!

LemonJello · 18/12/2018 07:36

If I was an NHS hiring manager, the woolly nature of how these two laws interact and the potential to be sued either way would mean that I would try and steer well clear of hiring any trans HCPs.
And that’s not right.

LemonJello · 18/12/2018 07:41

The language here is fucking awful.

“to exclude them from carrying out female-only care”

Procedures such as cervical screening are for the benefit and wellbeing of the patient. Their purpose is not to provide an “inclusive” environment for NHS Lothian staff Angry

TimeLady · 18/12/2018 07:53

You'd like to think that any HCP would have empathy with their patients and recognise themselves that this could be a problem.

Presumably a male HCP won't have had much, if any, experience of performing cervical screening as a man, so it's not as though they'd suddenly be stopped from doing it if they transition. And if, as a transwoman, they suddenly decided that they'd like to start undertaking such tests, that'd be a big red flag for me.

PlectrumElectrum · 18/12/2018 07:55

You'd like to think that any HCP would have empathy with their patients and recognise themselves that this could be a problem.

And failing to see this is in itself a bloody good reason they should not be anywhere near women for the purpose of providing any intimate health care treatment/screening.

ChristmasWrappingTheWaitresses · 18/12/2018 08:02

James Morton is a trans man.

So disappointed in these females who have rejected being women. They seem to abandon us with disgust much as many gay men do.
