Hi,

Does anyone know if universal credit back date the child disability element from when you first called dla for the claim form (which dla too will back date) or does uc child disability element start from the date dla make the award?

Thank you

If its over a month, you can fill up the complaint and they'll contact you up to 2 days.

That's what I did as mine was over a month as well, and next day after complaint everything counted and 2nd letter in my account xx

Make a complaint about JSA or UC - DWP

@Samgib90 i would definitely message them again they should have added to your entitlement soon as verification is completed (which only took a day for mine). So you should have seen on this months statement if you did a change of circumstances a month ago x

They have updated the payment for this month now! But nothing about back pay so I have put it in the journal. Thanks

Samgib90 · 15/03/2024 16:09

So I have been awarded disabled child element! But today they have backdated only 1 month! I am owed 16 months as was unaware I was entitled to the benefit! I have put in my journal it should have been back to when she received dla! Am I right they will have to back date to then. Thanks

Daniellemcm · 15/03/2024 21:06

@Samgib90 from what I have seen online soon as you request back payment on your journal they should then send it to a decision maker to look at backdating. You should then receive a letter saying if they agree special circumstances applied for late reporting of change of circumstances (I’ve not seen anybody be refused and people in your situation have simply said they wasn’t aware of the entitlement). It might take them a while to do your back pay (send 2nd letter with amount owed) as they have to adjust your statements but as long as you get letter saying they agree special circumstances apply you will get the back pay. Hope that makes sense xx

CoolLimeSheep · 16/03/2024 05:27

Hi I put in a change of circumstance for back dated child disability payment from 2021 I had a update from case worker saying it had been accepted just waiting for verification. Does anyone know what that means?

Daniellemcm · 16/03/2024 09:25

@CoolLimeSheep from my understanding it first get sent to a verification team to double check that you were in receipt of DLA for the time period you have put on your change of circumstances and still so they can apply the element moving forward. Once verified your case manager can then put a request into a decision maker for back pay. Just make sure you put on your journal you would like it backdating as they don’t automatically do it you have to request it be backdated x

CoolLimeSheep · 16/03/2024 10:04

Thanks I've already asked for it be back dated from 2021 in my journal my housing gave me the uc regulation (paragraph 31 schedule 1 of uc regulations) to help with backdating x

Daniellemcm · 18/03/2024 10:00

Just keeping everyone updated got my 1st letter this morning on journal saying they agree special circumstances apply so just got to wait for statements to be updated & 2nd letter with amount. Hopefully not too long await 🤞

Daniellemcm · 19/03/2024 09:55

Really quick turn around got my second letter this morning and back pay will be paid within 3 working days hope those of you still waiting have speedy updates too xx

That's really great. It took 3 weeks for my 1st letter. And it's a week today since my 1st letter so still waiting.
Glad you didn't have to wait long.

Child disability element universal credit
Daniellemcm · 19/03/2024 18:47

Mine took a day but they didn’t let me know it had been verified til a week later when I messaged them would drop message on your journal in a few days if you haven’t heard from them x

CoolLimeSheep · 19/03/2024 22:03

Hiya mines with decision maker about back pay will be 2 weeks on Monday
Hope you hear soon and I'll keep everyone informed on mine

Razz50 · 21/03/2024 14:08

Just to update...I requested the change on the 8th March and was told they had till 22nd to work on it, I left a message today and recieved a reply that they agree to add the disabled child element to my claim going forward and it will be included in my payment on the 5th April
I replied to ask if it will be backdated and was told the decision for backdating has not been made yet and that I will receive a message on my journal if it is
So at least I know I have the element added to my claim now...hopefully the backdating decision isn't long

Samgib90 · 21/03/2024 21:43

I added the change 14th Feb got it approved! But in journal about back pay which I was told its with decision maker! But had no letter confirming this or a dead line, just in my journal when I said I want back dating looking into as was unaware I was entitled! They just said it is with them. Thanks

CoolLimeSheep · 27/03/2024 15:54

They've said to me today I have wait to see if child disability in on my next statement which is 15th April before they can work out how much they owe me. Has that happened with anyone else I reported it 11th march

Razz50 · 28/03/2024 13:33

Another update my backdating has now been approved and the money is due to be paid before the 3rd April
Initially reported change 8th March so roughly a month for the whole process

Glad your wait is over! They told me it can take up to 4 weeks, I reported on 20/03 so it's only been just over a week now. If you're not fighting with DLA you're fighting with UC! The whole process is a joke. X
