Hello!

My claim was received 27th October and just called they said it’s with the decision maker and was picked up last Wednesday, does anyone have any idea how much longer it will be?! The woman was really unhelpful on the phone they’re usually much nicer!

Will be 12 weeks next week since they received my claim. How long usually is it once the decision maker has all the paperwork?
Thanks!

Adamd12 · 12/01/2022 18:33

Has anyone been able to get through on the phone recently? Waited for 40 mins yesterday and an hour to day and no one answered

IMissSleep · 12/01/2022 18:54

I rang today at 10am on the dot and was their first caller!

Mummy2boys1520 · 13/01/2022 10:55

I'm waiting to hear regarding a change, my son already get hrc but I've asked them to look at mobility again currently getting lrm. Hoping I'll here soon as his current school won't even take him on trips due to them not being able to guarantee his safety I've been told it can take up to 16 weeks at the moment
@Adamd12 Friday will be 18 weeks for me waiting for a reconsideration/change of circumstance decision. They told me 2 weeks ago that it was 16weeks until a case worker even looks at them. ☹️
Hi, just wondering if you had any movement on your change of circumstances, think you were upto 18 weeks a while ago?

Littlely8384 · 13/01/2022 16:25

@Adamd12 finally got decision today would have been 19 weeks tomorrow. Been increased to HRC and backdated full 19 weeks.

Adamd12 · 13/01/2022 17:14

Ah glad you finally got it sorted, mine is 13 weeks tomorrow so probably 5-6 weeks to go

When did you send your form? I'm waiting for a a change aswell. 11.5 weeks since they received my sons form. I'm desperately hoping to hear back before or around 16 weeks because we're moving house a couple weeks after that 😬
Imitatingdory · 13/01/2022 20:32

Mummy2boys1520 that is potentially disability discrimination.

Mummy2boys1520 · 13/01/2022 20:59

@Imitatingdory I've said this as the school that he is in which is a special school have suspended him 3 times now yet it's meant to be an social emotion and mental health to support him but his gone worse they are constantly calling me to go to the school to pick him up or to calm him down as they would say his in crisis but won't help with getting me the support he needs

I sent mine the beginning of October but still haven't heard anything I keep calling but when I do they say it is taking longer as they don't have many cases workers working right now. Then I get told it's okay as your still receiving the hrc but it's like I wouldn't be asking for a change if it was okay

Asking you to pick DS up without formally excluding him is an illegal exclusion. Refuse to pick him up without being given formal paperwork. This can seem harsh, but the formal exclusions give you more evidence of unmet needs in order to get further support &/or another placement.

Also ask for either a reassessment of needs or early review. Do you have another school in mind?

Contact IPSEA or SOSSEN for help with whether you would have a Disability Discrimination case (for either the exclusions from trips or the school exclusions or both).

Mummy2boys1520 · 13/01/2022 23:43

@Imitatingdory they do it all the time they have even been talking about putting him on a part time time table because they can manage him we are in the process of finding him a new school but waiting for schools to say weather he will fit with what they offer. The school he is at the moment are not the best. But hoping once we have a new school we will see an improvement in him as well

They may do it regularly, but it is still unlawful, and you can challenge it.

SBParker99 · 15/01/2022 16:49

@Alk19 did you decide how much UC take to cover the backpay, just UC told me they would automatically deduct some but didn’t give me any idea how much they was going to take, so i’m a little bit stressed now

Alk19 · 15/01/2022 17:02

@SBParker99 I already had a budget loan coming out so maximum they were allowed to take was £43 or something like that there’s a maximum there allowed to deduct for ‘debt’ mine is £120 odd pound a mo th there legally allowed to take x

SBParker99 · 15/01/2022 17:05

@Alk19 thanks so much it’s really been stressing me. do you know if they take the amount for carers in to account, i get standard under 25 rate, disabled child and carers element but they deduct my budgeting and carers allowance so i’m guessing mine wouldn’t be far of what they deduct from you

Alk19 · 15/01/2022 17:17

@SBParker99
They deduct the 292 a month for carers but that’s not classed as debt that’s separate as earnings x

SBParker99 · 15/01/2022 17:19

@Alk19 so would that be included in the amount they deduct 25% from?

Alk19 · 15/01/2022 17:55

@SBParker99 no that’s not included x
