Husband sacked Can anyone help me work out what we can claim?

I'm completely confused ! We have three children - age 7 11 and 15
I'm self employed but only earnt 4k last year
He now doesn't have a job
We have a mortgage

What do we do???? Xxx

Sadly, his employers have done exactly what will be expected of them to comply with best practice

imagine the daily fail headline if they were to reinstate him

he was an utter twit to 'forget' to mention an arrest for Class A in a job application in the health service.

You are lucky they do not try to claim back his salary.

He needs to sit down and "sort his shit out" in all senses of the words
and decide where his priorities lie.

It may involve you stepping up to the plate and him being a SAHD while he reskills

He was suspended with full pay in December, no hasn't applied for any jobs didn't think he could/should with this going on? He was also very hopeful of being reinstated plus his boss etc was very supportive

He started smoking again about 8 weeks into the suspension

It's very likely that he'll be sanctioned for this. That's up to 26 weeks of not being paid benefit, starting from when he puts in his claim, so he needs to do that ASAP.

He also needs to stop wasting money on drugs.

looking back he's dealt with it all very badly - didn't have any representation nor advice

He wasn't in union although joined the day of suspension (I know!) but they were unable to advise

Could you see a solicitor for 30 min free advice? Or legal line on your house insurance ?

Can he look for some interim work that doesn't require his professional registration?

II'm assuming he's either an accountant or clinical, either way some interim project management work might be possible on a self employed basis.

It would be worth taking legal advice about pursuing an appeal. It might be possible to get a final written warning demotion rather than dismissal?

Do you have friends / family who can offer emotional / practical support?

Can he work for agencies that supply the NHS? If he is senior and works in a specific field then he may be able to get contract work - eg, there are agencies that specialise in NHS IT people. He could explain his drug conviction to them, offer his services at less than the usual rate and still work.

Your DP has lost the job for not declaring the conviction. Other trusts may employ him if his skills are needed and he can show he is otherwise a good employee.

But as he is still now using drugs is he actually a good prospective employee?

You may be entitled to income support I think if your DP is sanctioned for being sacked and doesn't get JSA immediately. That would dpend on your overall household income as is means tested. You may get it if you have no other income coming in.

He seems to think the idea of picking up labouring is him finding another job

I'm finding it so frustrating he's not out there looking for an alternative using his degrees etc albeit not in the same capacity

No, the 6 months off and smoking definitely dumbed him down I fear he wouldn't be able to even interview properly - such a shame he is/was highly respected and skilled in his job

I believe so, but happy to be proven wrong.

He would have day to day care and even in the event of saying he's drinking and using drugs, it's then your word against his. Women on here over and over again are told as they are primary carer despite what allegations are made by stbx they will retain that status.

He needs to get himself on linkedin and connect with some recruitment agencies, they will find him some work, employers even in the nhs are less fussy about interims they're not directly employing.

Don't let him mess about labouring, he had responsibilities and needs to get a grip.

He's hiding putting off putting on his suit and facing his contemporaries.

I've seen people sacked for worse in the nhs move into some interim positions rebuild some reputation and then get back on a permanent contract.

I agree with MrsL. I have seen similar come backs in the public sector. Is he on LinkedIn? That seems to be a good source of job opportunities for free lancers.

If he sets up a good profile on linkedin the agencies will find him, I'd suggest connecting with someone like Real Staffing, but to be honest it depends which agencies are active in your area.

I assume he's considered to have brought the profession into disrepute, the nature of the charge combined with falling to disclose it.

It hadn't been confirmed that he's been barred until we get the paperwork but the presumption is that he will be as he broke their terms of registration - it was reiterated countless times if it was just down to his employers he would have kept his job but it was due to the terms of the governing register that couldn't be argued with
