Hi, gone through a seperation from partner and we have toddler together. I moved out of his property and into mine due to relationship failing. This involved a 25 miles and I didn't tell him about it in advance and as a result he's not happy and .is trying to see child as often as possible and pushing for more access. I currently allow him to seems on every weekends for 8 and overnight once a month. He has pushed forward with mediation and prevented me registering child at nursery.stating PR and saying he could care for child meaning moving towards shared care 50/50.As a result we are heading to court and I wanted to know how the court is likely to look at this, I filed a specific issues order and he counted, I will struggle not having son with me and my solicitor told me to claim DV. Thanks

The system is more more against you than you are being against his dad.

Then other parent. The one who is entitled to 50% of raising his child.

Why did you pull out ? That won’t look good. I hope you’ve got a car because if you moved away for no good reason you will have to do the travelling.
Is your ex a danger to your son ? If not why are you trying to prevent them having a relationship? That is very wrong and gives women a bad name.
Your ex could ask for 50/50 or to be the primary carer.
I really hope your solicitor didn’t tell you to lie a bout DV.

If not it would IMO be in the child’s best interests to live with their father full-time and for the OP to have supervised visitation.

She sounds vindictive at best, abusive at worst, and is that mother who is prepared to use her child as a weapon against their father.

I hope he is given primary residency. Women like the OP are despicable, and unfortunately there are more of them than MN likes to admit sometimes.

It’s people like the OP who are proof positive that there absolutely are women who are prepared to lie about having been in abusive relationships in order to spite their ex’s and use their children as weapons. They’re the worst kind of parents imagineable.

The court is unlikely to see this as a suitable compromise. They are much more likely to order 50 / 50 so half the week each especially as your ex has permission to go part time.

Yes the will most likely have a report about the mediation.

Why dont you want him to spend time at his dads? Because you broke up? Why are you refusing mediation (and yes, I'd hope the court found out that you did). Let your son have a proper relationship with his father! The number of women on here whose ex's want nothing to do with their kids and here's this man, fighting to see his son and you are being petty and obstructive. Hopefully the court will see through this and he will be awarded at least 50/50

Yes the courts will know everything as the mediator as to let them know! tbh I don’t think you will have any sort of leg to stand on…if there wasn’t any DV involved then you shouldn’t be lying but the courts will know the truth anyway they will see past your lies…maybe you should just agree to the dad having custody of your child and you have over night stays when he turns 5 instead..I think you need to seek some sort of help from your Dr so probably best your child doesn’t stay in your care for the time being

How old is your child and have you ben the primary carer for the child?
Why do you not want 50/50 with your ex?
25 miles is not the ends of the earth tbh.
When you say "emotional abuse" what do you mean specifically?
emotional abuse can be considered domestic violence so perhaps thats why your solicitor mentioned that?
Do you think your ex is a good father to your child generally?

It sounds more like op insisted on her way and shut down any discussion. Him wanting to discuss decisions is not EA.

You can't keep your son away from his father just because you don't want to share him!

You can't lie about your Ex just to control the narrative.

A court would see right through you and realise that you have been as obstructive as possible.

My advice would be to start trying to compromise and offer mediation and your ex more time with his son or you might end up with less than 50%.

OP if you try alienateing your child from spending time with their father for no apparent reason whatsoever other than you are concerned the child's father gain full custody, you may in fact end up with an extremely resentful child who may well alienate you back once they are old enough to do so.

I don't find communicating with ex very helpful, so I never wanted to do mediation in the first place. he pushed for this. Son is unsettled more after seeing dad and crys when ex drops him off.and he is still young.

That is probably because he doesn't want to leave his dad.....

The system is there to put the interests of the child first. You sound very controlling and self-absorbed. He is the father and it's not your choice to grant him over night access at 5.

It’s not a sleepover, it’s being with his parent, exactly the same as with you. You need to compromise and communicate or it’s going to get much worse for you.

You don’t get to unilaterally choose that he can’t see his son, and you are the one to allow/grant access as you see fit.

wow your actions are so selfish and thoughtless. youre not interested in whats best for the child at all. only whats best for you!

i hope your ex gets full custody and you get visitation now and again. problem solved. see if you like it with the shoe on the other foot… Your ex sounds thoughtful reasonable and balanced. potentially a good dad.

Sleepovers are for grandparents or for your child to have fun night with a schoolfriend.

Sleepovers are NOT for parents. Offering a sleepover once he turns 5 is not baeing reasonable or attempting to compromise. It is acting in a controlling manner to the detriment of your son's relationship with his dad.

No-one cares what you want. it is all about what is best for your son.
