Hi, gone through a seperation from partner and we have toddler together. I moved out of his property and into mine due to relationship failing. This involved a 25 miles and I didn't tell him about it in advance and as a result he's not happy and .is trying to see child as often as possible and pushing for more access. I currently allow him to seems on every weekends for 8 and overnight once a month. He has pushed forward with mediation and prevented me registering child at nursery.stating PR and saying he could care for child meaning moving towards shared care 50/50.As a result we are heading to court and I wanted to know how the court is likely to look at this, I filed a specific issues order and he counted, I will struggle not having son with me and my solicitor told me to claim DV. Thanks

How would you have felt if his dad just upped and walked off with him one day.

Wouldn't allow you 50/50.

Accused you of EB in truthfully.

And emotional abuse is t wanting to discuss things.

He sounds like the more grown up one of the 2 of you. At least your DS will have 1 fair and grown up parent in his life.

This must be a reverse, because what you are suggesting is horrific. Denying a child a relationship with a father who is quite clearly going out of his way to maintain one is abhorrent. Having a vagina doesn’t give you ownership of a child who was created by two people.

You really need to rethink your approach, to this, including getting a new solicitor who doesn’t suggest fabricating lies which will be easily discovered (you have no evidence of DV because there isn’t any).

I’d be surprised if the court ruled anything other than 50/50 care here, and if you continue with this line of behaviour you’re risking accusations of parental alienation.

This is not just your child, you don’t need to pay for nursery when the other parent is willing and happy to look after him, and frankly the court don’t care what you want, only about what is best for the child. I don’t see any reason here from what you have shared that 50/50 isn’t in the child’s best interest.

Once you are at court you have very little say in the outcome and Dad may get more than he initially expected. Maybe Dad would have initially been happy with EOW plus an overnight mid week. You are better off taking a deep breath, going back to mediation and having a mature conversation that considers everyone's needs properly.

The courts won't be in the least bit interested in whether you struggle being away from your child, they will consider his best interests.

Arguing about decisions isn't emotional abuse and courts are wise to false claims of DV to try to alienate the other parent.

Of course he will get 50:50 and in this case he absolutely should.

I know it's hard for you to be away from your child but the courts are not interested in what's difficult for you. Their job is to make sure that the child has time with both parents as this is important for the child's wellbeing. They are duty bound to act in the child's best interests, however difficult that is for you. I imagine it's hard for your partner to be away from his child for most of the week too.

If you think you have genuine advice wouldn't it be best to read the thread properly first ?
Write a timeline op. .keep a diary of ex's behaviour..build a case.

You mean your son not spending time with his dad? You sound like a horrible person trying to deny the father his right to see his child.

Sounds like the dad is very sensible and not at all selfish unlike yourself. You NEED to put the childs best interests first and that is having 2 parents to look after and raise them.

I really hope this is a wind up....

Sorry but this doesn't stop him being your sons father. It also doesn't stop him being a good father.

You need to deal with your own emotions and stop it from impacting your son who must be very hurt and confused by everything.

It's not appropriate to send him to nursery to withhold him from his father. The more you try to prevent him from spending time with his father, the worse things are going to get for you, and worse than that, for your son.

You’re acting horrendously. You’re selfishly thinking of yourself. You’ve given no reason why the child can’t see his dad. If you prevent access, your child will remember how you’ve treated him.
you need to be a grown up. This is what happens when you have a child with someone and it doesnt work out. You MUST facilitate a relationship for them.
