The school suspended a 10 year old girl for improper behaviour when confronted with the video of her gang rape.

Shame on them.
Shame on all those who distributed or watched that video.
Shame on the adults who even attempt to look for signs of how "willing" that child was.
Shame on a system which enabled a school to think they could make this "story" go away.

My entire country needs to come out of this with a completely different perspective on girls bodies. I don't hold out much hope... the change seems to only happen by tiny shifts.

I'm livid that all I can do is type on the Internet. I want to scream.

Not if the other children involved were also children of the same age. This is not a situation of adults abusing a child, this was a case of a child left her hotel room while on a school trip, went to her classmates room and the started to have sex while friends recorded it. So if it rape should the 10 year old boys be jailed?

I think you are talking about the age of criminal responsibility. Generally, it can be waived if the crime is serious enough. Rape of a child appears to be serious enough to hold other 10 year olds criminally responsible under most legal systems.

Then there is the filming angle.

I’ve tried reading the law and from what I am seeing it is illegal for two minors to have sex even when both consent but it is not declared rape. However in practice it is against public interest to charge them as they are minors.

I haven’t seen anything that says it is rape even if they are both minors unless they forced her.

What are you reading? Just read the Sexual Offences Act 2003. Yes they would be vanishingly unlikely to be charged but that doesn't mean that the girl wasn't raped and the boys weren't sexually assaulted. Force has nothing to do with the legal definition of rape.

Anyway no point arguing about this, I really hope they get the help they need. And authorities get tk the Bolton of where they learnt such behavior. I also hope they are not just punished but nothing by done to address the why. I am Nigerian and as I said we tend to look down on mental health and therapists etc and would rather go to church to pray.

The girl cannot give consent simply because she was 10. It’s as simple as that.

No one is saying the boys should be locked up, as far as I am aware no one is even saying the boys were at fault but that doesn’t change the fact that this girl was raped. I think most people on this thread wholeheartedly agree that there shouldn’t be a punishment for these children, they need help.

The op is, quite rightly in my opinion, furious because this poor girl has been seemingly scapegoated for this entire event. She was 10 and they are blaming her which is fundamentally wrong.

Because 10 year olds cannot give consent. You are suggesting that boys cannot be guilty of rape because they are under-age and therefore anyone having sex with them, whether consenting or not, must have sexually assaulted them?

Thats not really the way the law works.

That poor little girl. That's despicable. All of it. All despicable. Reminds me of about a decade ago when I read about a 13 year old girl who was dragged to an arena and stoned to death for adultery after she had been raped. She cried "oh no, don't kill me!" while dozens of men buried her up to her neck and pelted her head with rocks. She was a child raped by men and then held responsible for it.

Legally it is impossible for a child of that age to give consent.

The legal age of sexual consent for heterosexuals in the UK is 16. Consent means agreeing to something, in this case to having sexual intercourse. Statutory rape is when one or both of the parties engaging in sexual activity are below the age of consent. Statutes are laws.(bbc bitesize)

In summary I don’t agree with the definition of rape in this case but it serves no purpose continuing to argue.

The important thing is we all agree that all the kids boys and girl involved need lots of therapy and help and I really hope they get the help they need.

And it's rape anyway. If the U.K. if boys penetrate under 13s with their penis, they are raping her. It doesn't matter how old they are. In Nigeria, the age of consent is 11.

Please don't misrepresent what I have said.

In nearly every country in the world, rape is where one person under the age of consent is involved. No child can give consent. Thats the case whether the person having sex with them is under the age of consent or not. It doesn't negate the act of statutory rape.

I'm sure you must be aware of this so why you are persisting in your statement is a bit ... hmmn.

Can you explain why you are doing this?

In Dubai, sex outside of marriage is illegal.

In the United Arab Emirates, there exists a different kind of punishments for crimes including capital punishments for the most heinous of crimes such as rape. Sexual assaults are heavily punished in Dubai and can often include death sentence, especially in instances of sexual assault of minors

No 10 year olds should be having sex during a school trip.

How many times have prestigious schools or universities covered things up because they don’t want to ruin their reputation.

The only reason this has come to light is because the video was leaked else she would have still been called a liar.

The school is partially to blame for not realising the girls and boys were mixing.

They are all under age so by UK law I believe the boys would be accused of raping her and she has sexually assaulted them - all of them need serious help.

As this was in Dubai and they’re Nigerian I don’t know of the laws but the filming and leaking it will have a high sentence in itself, especially if adults are sharing it.

I agree the filming and distribution of the video are extremely serious. If adults are involved in any part of this I hope they have the book thrown at them.
