Accident in gym, pretty annoyed 😕

Bit of a rant, a few weeks ago at our local DL club, my husband suffered a dislocated shoulder. My daughter was having her gym induction and being shown how to use the treadmill, with the gym instructor on the other side. The man using the treadmill on the other side of her stepped off and took his water bottle with him so my husband went to step on his treadmill to be next to my daughter, only the complete twat left his treadmill on level 14!!! My husband basically flew off, spun round and landed smack down on his shoulder.

all of this in front on my 12 year old daughter. He somehow managed to hobble down the stairs, where they tried to call him an ambulance, only there was a 6 hour wait so I took him up instead. He was treated relatively quickly (3 hours) and had his shoulder reset and sent home with pain meds.

My hubby had a meeting with the manager to discuss a gesture for the incident and he’s offered…2 months free membership for my husband and 3 free PT sessions.

part of me is insulted by this, it’s something that should never have happened and quite a serious incident that happened in there club. Did the member who left the treadmill on have an induction telling him how to use the equipment correctly etc? Everyone who knows thinks it’s awful what’s happened and David Lloyd should be taking more accountability for what’s happened.

the other part of me thinks I should pipe down and this isn’t the USA where everyone’s dues everyone 😂 I have looked online and a no win no fee case could be between £2k-£48k so I kind of feel David Lloyd aren’t taking it that seriously ☹️ my hubbies going to have up pay for lots of physio now

our DH stepped onto apparatus without checking. If he had completed the induction he would have been told to always check that it is safe to do so first. If he hasn't done the induction then he was clearly wrong for trying to step up onto a machine that he hasn't been briefed on.

Instead of looking online at no win/no fee pay a fee and go and speak to a solicitor about what your rights are. I absolutely think £48k compensation isn't unreasonable for discomfort, loss of earnings and private physiotherapy. NHS physiotherapy has a very long waiting list and the more and earlier you get physiotherapy the less long term effects there will be.

Speak to a properly qualified person, a solicitor who specialises in personal injury claims. Also, if the gym aren't responsible, then maybe the man who left it running is and you might have a case against him.

You’re having a laugh. My son contracted severe salmonella poisoning from an all inclusive hotel - spent FOUR WEEKS in hospital seriously ill, now has IBS for the rest of his life. Almost daily painful stomach aches and toileting issues. We went through eight long years of legal proceedings and at the end of it he got £7k. Dislocated shoulder…… not so much.

As you said in your opening, this was an accident. The gym are actually being generous rewarding stupidity.

So.... your husband made a decision to use gym equipment inappropriately ie as a viewing platform rather than to exercise he was completely Ok about doing this rather than leaving empty for a gym member to use...doesn't check where he is going to stand...I mean as you said level 14 is quite a pace he would have to be pretty daft to not notice....but this is all the gym's fault/ Quite frankly I think you are lucky they offered him anything! NHS will sort physio if you ask them.

So your dh would like compensation for attempting to get on a fast moving treadmill and falling off it? Confused

Now every other poor sod's gym induction is going to be full of "switch the machine OFF when you step off, check it is OFF before you get on" type advice rather than anything actually useful because it seems like we have outsourced common sense these days.

Oh god, op. Cmon, I’m cringing for you, the man got off to refill his water bottle, left it running as it normal and your husband tried to grab it so fast he hurt himself. And now you’re on the compo trail. The staff at the gym’s toes will be curling, he’s lucky to get what he’s been offered. I’d be too embarrassed to go back if I was him.

It's not their fault that the customer left it on or that your husband managed not to notice it was moving before he got on. If I were them I'd be getting your husband to sign a contract saying he will use common sense in their building. He's the liability! Confused

I read it it wasn't on, but was shut down or maybe paused with speed 14 on, so when he started it, it made him fly.

You are lucky to get anything at all. It was an accident and he should have looked before getting on to see if it was moving or not.
I would be getting this post taken down. Especially as you have named a company.

she said the previous person left it on no 14., she didn’t say it was still on running.
So yeah I understand it was OFF but left on No14 so when her DH got on, turned it ON, it went straightaway on to no14.

That's not generally how treadmills work! They'd be terrifically unsafe if they did that !

A friend of a friend's feral child climbed up on a chair in DL, it fell out from underneath them and they were quite badly injured. The mum is convinced DL was to blame, expecting a freeze on their membership etc. it blatantly wouldn't have happened if they had not let said feral child climb up and/or she had supervised. Makes me so mad. Whatever has happened to personal responsibility!!

surely treadmills have a deadman's handle type safety cut off? It is impossible to leave them running in our gym.

People sue in the US to get their medical bills covered, so no you absolutely don’t have a leg to stand on comparing yourself to US cases, especially as your husband should have checked where he was stepping first! He had an accident. It’s not like DL leave their treadmills going.

Just been to the gym and it's bloody hard to get off a still moving treadmill and near impossible to get off one going really fast.

It's completely your DHs fault for jumping on a moving treadmill.

If my DH came home and told me that he did that I'd piss myself and tell him he's a stupid bugger!!

What exactly do you expect the gym to do? Have a member of staff check each piece of equipment before someone uses it? Your DH was an idiot for getting onto a moving treadmill. Seriously have you no sense of responsibility or shame?
