Accident in gym, pretty annoyed 😕

Bit of a rant, a few weeks ago at our local DL club, my husband suffered a dislocated shoulder. My daughter was having her gym induction and being shown how to use the treadmill, with the gym instructor on the other side. The man using the treadmill on the other side of her stepped off and took his water bottle with him so my husband went to step on his treadmill to be next to my daughter, only the complete twat left his treadmill on level 14!!! My husband basically flew off, spun round and landed smack down on his shoulder.

all of this in front on my 12 year old daughter. He somehow managed to hobble down the stairs, where they tried to call him an ambulance, only there was a 6 hour wait so I took him up instead. He was treated relatively quickly (3 hours) and had his shoulder reset and sent home with pain meds.

My hubby had a meeting with the manager to discuss a gesture for the incident and he’s offered…2 months free membership for my husband and 3 free PT sessions.

part of me is insulted by this, it’s something that should never have happened and quite a serious incident that happened in there club. Did the member who left the treadmill on have an induction telling him how to use the equipment correctly etc? Everyone who knows thinks it’s awful what’s happened and David Lloyd should be taking more accountability for what’s happened.

the other part of me thinks I should pipe down and this isn’t the USA where everyone’s dues everyone 😂 I have looked online and a no win no fee case could be between £2k-£48k so I kind of feel David Lloyd aren’t taking it that seriously ☹️ my hubbies going to have up pay for lots of physio now

I would imagine that the first pt session will be teaching him to check the equipment before using it. You wouldn’t touch a weighted machine without checking the weights.

I think the best way to decide is to think through how the gun could have prevented this. Some kind of “dead man’s key” like a jet ski? That’s not industry standard. I’ve not ever seen it. 1:1 supervision? What would that go to membership fees?
personally I can’t think of anything the gym should have done to prevent this so I’d take the free sessions and membership and use it for rehab.

Level 14 would have seen the man sprinting next to your DH. He must have jumped up on the sides and worked his way off for some reason. However the machine would also have been loud even with no one on it!

Some of the responsibility definitely has to lie with your DH.

And he doesn't have to pay for Physio, he can access it on the NHS. Most places allow you to self refer to physiotherapy.

This is ridiculous. You husband is the liability and shouldn’t be anywhere near a gym if he can’t tell that a treadmill is on.

That is not the gyms fault. And I’m also a bit 🧐 So, the guy who was on the treadmill was running at a high speed, did no cool down or even a tiny slowdown whatsoever, just went from running really fast to somehow just stepping off a fast moving machine and leaving?

Are you saying the treadmill was stationary and it started at 14 when he stood on it?

I can't decide what's worse...

A. He seemingly couldn't hear or see a treadmill on level 14.
B. He was in charge of a minor when he couldn't hear or see a treadmill on level 14.
C. He hit his shoulder, was able to get down stairs, yet someone was going to call an ambulance? If you can walk down the stairs with an injured shoulder then I'm sure you can sit in a car without taking up an ambulance. I'm not surprised they said it would take many hours.

In fairness on point C, dislocated shoulders are really painful, and patients often require an ambulance (I’m an A&E dr/urgent care GP). But yes to points A and B.

Something doesn't make sense here - it would be impossible to get off a treadmill on level 14, let alone get on one moving at that pace. Was there some kind of fault with the machine so that is stopped for the previous man to get off and then restarted without warning?

My elderly mum dislocated her shoulder and didn't seek medical help for three days. They don't make 'em like they used to 😆

Surely the only way this can happen is if the treadmill was stopped and then he stepped on it and pressed to start and it resumed at lvl 14?

With legal it's a mix, then the gym could say it's also the responsibility of the customers to make sure the machine is ready to use

I think you can pause it or something as something similar happened to me before but not as dramatic as it wasn't so quick.

I think the club should have watched the cctv from the incident and found the person who did it and explained what had happened. Maybe even put signs up reminding people to turn off equipment after use...but compo...I'm not sure why they should be made to pay it so I'd take 2 months and say thank you (gyms.are expensive so this must be worth over £100)

It's potentially one of two peoples fault, or six and two threes. The person who jumped off and left the treadmill moving, or your DH for getting on a moving treadmill.

Why should the gym be out of pocket?

Greedy, grabby and embarrassing.

There’s always someone whose eyes light up and start flashing dollar signs anytime an accident happens. And I’m being generous calling this an accident - your husband was entirely negligent about his own safety. Paying for any resulting physio needs should be entirely at his own cost.

I hope DL ban your husband, he clearly can’t be trusted around gym equipment so why should they put themselves at risk of spurious compensation claims from his salivating relatives?

It’s hard to step off a treadmill that’s moving even slowly so I’m not sure how the guy could have got off of it while it was on level 14. Also, surely every reasonable person knows not to step onto a moving treadmill? Apart from your husband apparently.
