Accident in gym, pretty annoyed 😕

Bit of a rant, a few weeks ago at our local DL club, my husband suffered a dislocated shoulder. My daughter was having her gym induction and being shown how to use the treadmill, with the gym instructor on the other side. The man using the treadmill on the other side of her stepped off and took his water bottle with him so my husband went to step on his treadmill to be next to my daughter, only the complete twat left his treadmill on level 14!!! My husband basically flew off, spun round and landed smack down on his shoulder.

all of this in front on my 12 year old daughter. He somehow managed to hobble down the stairs, where they tried to call him an ambulance, only there was a 6 hour wait so I took him up instead. He was treated relatively quickly (3 hours) and had his shoulder reset and sent home with pain meds.

My hubby had a meeting with the manager to discuss a gesture for the incident and he’s offered…2 months free membership for my husband and 3 free PT sessions.

part of me is insulted by this, it’s something that should never have happened and quite a serious incident that happened in there club. Did the member who left the treadmill on have an induction telling him how to use the equipment correctly etc? Everyone who knows thinks it’s awful what’s happened and David Lloyd should be taking more accountability for what’s happened.

the other part of me thinks I should pipe down and this isn’t the USA where everyone’s dues everyone 😂 I have looked online and a no win no fee case could be between £2k-£48k so I kind of feel David Lloyd aren’t taking it that seriously ☹️ my hubbies going to have up pay for lots of physio now

How on earth could the original guy have got off the treadmill while it was running at 14?

There’s a technique. You first of all put your hands on tne side rails, then put your weight into your hands then you sort of jump your feet to the stable sides of the treadmill.

To get onto a moving treadmill you do much the same thing except you start sort of running in the air and only let go your hands when you’re confident on your feet. It takes some timing running at 14 or 16kph. I’ve done it for intervals of 10 seconds at 18 kph. That is a scary speed on a treadmill! 14 is ok.

it’s one of the first things my trainer taught me to do and I still use this technique even at walking pace on the treadmill. Once you master it, it can be done quite safely, but it’s never without risk.

But an empty treadmill running at 14kph makes a helluva noise.

BatheInTheLight · 15/07/2023 19:04

Lack of personal accountability these days. It's ALWAYS someone else's fault with some people 🙄.

There's no RULE to switch the treadmill off. Be hard to miss a treadmill running at full pelt surely.

gluteustothemaximus · 15/07/2023 19:00

This sounds like the treadmill was off but when turned off left at level 14.

That's what I was thinking. Why has everyone else assumed (very vocally) that the DH is a plank and has stepped onto a moving treadmill???

the OP literally says “Did the member who left the treadmill on have an induction…”

Left it on. Not left it on level 14 but turned it off. That’s why most people are assuming it was running.

Inyournightgarden · 15/07/2023 19:07

not sure if you’re greedy, stupid or both tbh

Starlightstarbright2 · 15/07/2023 19:07

One thing a gym can’t teach is common sense .

He knew it was moving .. what did he think would happen when he stepped on it ?

Totaly · 15/07/2023 19:08

Yes it can be someone’s else’s fault and to be clear - it’s not your judgement call is it? You don’t decide if someone has the right to make a claim or not! You sent in charge!

If anyone is injured they are entitled to put a claim into the business - it’s called public liability insurance. Use it.

Prescottdanni123 · 15/07/2023 19:10

If he failed to realize the treadmill was running then he was careless and lucky he didn't hit anyone else. A colleague did a similar thing. She flew off and hit another gym member. Colleague was alright. Her human landing mat wasn't.

It wasn't the gym's fault, nor the person who went on the machine before him.

HMW1906 · 15/07/2023 19:13

How do you not see/hear that a treadmill is still going at level 14? Is your husband blind? Had your husband had an induction about using the equipment safely? Sounds like he wasn’t listening he he has.

It is not the gyms fault that a member left the treadmill on. It is a) the members fault, b) your husbands fault for not noticing it was still on 🙄

Lada214 · 15/07/2023 19:14

I think what could happen was , the previous man turned it off and OPs DH stepped on it and it went straight into speed 14?
possibly a faulty machine?

HaveYouHeardOfARoadAtlas · 15/07/2023 19:17

MissGroves · 15/07/2023 18:50

This sounds like the treadmill was off but when turned off left at level 14. Ops H turned on whilst on it - and automatically at L14. Still DHs issue not DL - one of the first things you are taught is turn on whilst on the side bars/panels before stepping on the moving section.

That can’t happen. If someone stops it/turns it off at level 14 it will not restart at level 14 when switched back on. Basic safety feature. You turn it on and it’s stationary, you say what speed you want and it builds up to that.

Meeting · 15/07/2023 19:18

The fact of the matter is that to make a claim you need someone to be at fault. DL is not at fault therefore they owe you nothing.

AngelsandAliens · 15/07/2023 19:19

Always someone after something for nothing , no it was your husbands fault.

It’s like saying you went straight In the shower after someone at the gym and it burnt you , that’s not the gyms fault .

TheSeaDoesntKnowMyName · 15/07/2023 19:20

So why didn't he look before stepping on it?

WeeOrcadian · 15/07/2023 19:23

OP, before you look at a NWNF solicitor, get your DH down to Specsavers.

Here, have this for the journey: Biscuit

I can't decide what's worse...

A. He seemingly couldn't hear or see a treadmill on level 14.
B. He was in charge of a minor when he couldn't hear or see a treadmill on level 14.
C. He hit his shoulder, was able to get down stairs, yet someone was going to call an ambulance? If you can walk down the stairs with an injured shoulder then I'm sure you can sit in a car without taking up an ambulance. I'm not surprised they said it would take many hours.

I would assume he'd driven them both there. Pretty hard to drive with a dislocated shoulder so yes the gym would call an ambulance. He's obviously then called his wife when the wait was excessive.

I'm no fan of David Lloyd (I've cancelled my £85 pm membership) https://democracythree.org/help-emma-sue-david-lloyd but I fail to see how they are responsible. OP is talking about "no win no fees" so I suspect she's a chancer.

Help Emma sue David Lloyd

Please help me raise money to pursue legal proceedings against David Lloyd Leisure for discrimination and breach of contract.

25sheets · 15/07/2023 19:28

PS, I'm not Emma, above just to be clear. I saw this on Twitter.

Nanna50 · 15/07/2023 19:33

It’s a shame you’ve been framed wasn’t still on he could have got £250 compensation if he sent a video in.

And people would have said no that’s a set up, no one’s that daft.

Because everyone knows you don’t stand or sit on gym equipment if you’re not using it and everyone can see and hear a treadmill running at 14.

Autoflower · 15/07/2023 19:33

Why is he going to have to pay for physio?

babyproblems · 15/07/2023 19:34

Agree this is not ‘the gyms’ fault but just an accident and mostly your DH is to blame… I don’t think you’d get anywhere if you pursued them legally and Im surprised they’ve even offered you a gesture tbh! If your DH walked into a door in the gym would you feel the same?? There’s not much difference imo here, it’s on your DH to watch where he is walking! Also I’m not sure why you say ‘all this infront of my 12 yo’.. as if it’s a violent mugging. I mean it’s unfortunate your DH was injured but I wouldn’t describe this as a unbelievably traumatic thing to witness!!

LyingWitchInTheWardrobe · 15/07/2023 19:39

I think the gym should refund your husband's membership and ban him as he's not competent to use the equipment safely.

Anybody who doesn't check that the equipment is set correctly and more importantly, not still running, is trying their best for a Darwin award and has no place in the gym.

You do sound all about the compensation. I hope your daughter was paying attention during her induction.

Lada214 · 15/07/2023 19:41

@YouAreBeingUnbearable no that’s not what the OP meant.
she said the previous person left it on no 14., she didn’t say it was still on running.
So yeah I understand it was OFF but left on No14 so when her DH got on, turned it ON, it went straightaway on to no14.

MrsPerfect12 · 15/07/2023 19:44

My mum was knocked down (drivers fault charged in court) had extensive life altering surgery, had to move home, 9 months in hospital and nearly died.
She didn't receive 48k, I think you'd be looking at 2k max so I'd stop shopping now.

I'm pretty sure that isn't how treadmills work. All the ones I've used before reset to 0.1 when switched off then on again.

I notice that the OP has dropped and run - clearly this thread hasn't gone the way she thought it would

LyingWitchInTheWardrobe · 15/07/2023 19:49

Mine too, WeeOrcadian, they always re-set. It's a safety feature and it can be a bit annoying if you're working in but, safety first.

I do not believe that this treadmill would ever have defaulted back to 14 or any level other than stationary, ready to be programmed again.
