Accident in gym, pretty annoyed 😕

Bit of a rant, a few weeks ago at our local DL club, my husband suffered a dislocated shoulder. My daughter was having her gym induction and being shown how to use the treadmill, with the gym instructor on the other side. The man using the treadmill on the other side of her stepped off and took his water bottle with him so my husband went to step on his treadmill to be next to my daughter, only the complete twat left his treadmill on level 14!!! My husband basically flew off, spun round and landed smack down on his shoulder.

all of this in front on my 12 year old daughter. He somehow managed to hobble down the stairs, where they tried to call him an ambulance, only there was a 6 hour wait so I took him up instead. He was treated relatively quickly (3 hours) and had his shoulder reset and sent home with pain meds.

My hubby had a meeting with the manager to discuss a gesture for the incident and he’s offered…2 months free membership for my husband and 3 free PT sessions.

part of me is insulted by this, it’s something that should never have happened and quite a serious incident that happened in there club. Did the member who left the treadmill on have an induction telling him how to use the equipment correctly etc? Everyone who knows thinks it’s awful what’s happened and David Lloyd should be taking more accountability for what’s happened.

the other part of me thinks I should pipe down and this isn’t the USA where everyone’s dues everyone 😂 I have looked online and a no win no fee case could be between £2k-£48k so I kind of feel David Lloyd aren’t taking it that seriously ☹️ my hubbies going to have up pay for lots of physio now

How is this the gyms fault and not the person who left the treadmill on?

Never mind the fact your husband got on it without actually looking at it properly and assessing his own risks

I don't see how this is DL's fault? It must be pretty hard to miss a treadmill running so quickly so I'd say the majority of the blame is on the person not paying proper attention, which would be your DH.

Did he step back without looking?

The chap who walked off definitely should have turned it off - but he could have been stepping off to refill water, to get some cleaner or towel etc. Your DH shouldn't have been getting on equipment at all.

This is ridiculous!!

Your DH is the twat for getting on a moving treadmill! As a previous poster said, why on earth would he do that at that speed??

The only thing he can claim compo for anyway is financial loss, so if he’s been unable to work and doesn’t get sick pay. I suppose you can try and wrangle physio, but the NHS can provide that?

It’s unlikely though that DL can be held responsible for one of their customers not using the equipment properly. And it’s probably in the ts&cs that it’s down to each individual to use the equipment safely - which includes looking where you’re stepping.

Could he not hear the treadmill running? They're quite noisy. Honestly, it's not the gym's fault that one of their members was a dickhead and left the treadmill running, but I'd never step onto something without looking where I was putting my foot. Accidents happen OP. And no, this isn't the US.

You're right, this isn't the US. Your husband has to take some accountability here - he clearly wasn't paying any attention otherwise he would have noticed that the treadmill was still going. The gym shouldn't be held responsible for the actions of the person who left it running or for your husband failing to notice.

Surely human eyes are evolved to spot moving things. How did he not see that the belt on the treadmill was moving? Why didn't he hear the noise they make? I just can't believe it. It puts that "warning: hot coffee" case to shame.

This is odd as it would be quite difficult to get off a treadmill if it was still operating, especially if it was on at speed. They are also fairly noisy so how it could be on at speed and not be noticeable is odd too. I don’t see his this is the gym’s fault. The member who left it on has some culpability - it’s irresponsible to leave a treadmill running like that. It’s also partly your husband’s fault too, we all have to pay attention to what we are doing. I’d say he has done quite well out of this.

US personal injury litigation is totally different from here. Your DH would have to prove breach of duty of care. Good luck with that in these circumstances.

Maybe your DH should re-think a gym membership altogether? Doesn’t sound very safe, if he’s incapable of noticing that a treadmill is turned on.

Seriously? Why did your husband even think he needed to be so close to your daughter? What did he think he was adding to the induction process? Did his own induction not include an instruction not to hog gym equipment if you are not even using it?

Had your husband been taught how to use the machinery? It sounds like he wasn't intending to use the treadmill so much as stand on it next to your daughter? Did he approach it with as much care as he would if actually going to use it for a serious run?

I suspect he was distracted and didn't look what he was doing, because I don't think anyone who is getting on a treadmill to do exercise would fail to notice it was running. Or do you mean it was stopped but when he turned it on it defaulted to 14 somehow?

I think it was carelessness on both sides, so I'd be happy with what I had got and take it as a lesson to be more careful in future.

I can't decide what's worse...

A. He seemingly couldn't hear or see a treadmill on level 14.
B. He was in charge of a minor when he couldn't hear or see a treadmill on level 14.
C. He hit his shoulder, was able to get down stairs, yet someone was going to call an ambulance? If you can walk down the stairs with an injured shoulder then I'm sure you can sit in a car without taking up an ambulance. I'm not surprised they said it would take many hours.
