Accident in gym, pretty annoyed 😕

Bit of a rant, a few weeks ago at our local DL club, my husband suffered a dislocated shoulder. My daughter was having her gym induction and being shown how to use the treadmill, with the gym instructor on the other side. The man using the treadmill on the other side of her stepped off and took his water bottle with him so my husband went to step on his treadmill to be next to my daughter, only the complete twat left his treadmill on level 14!!! My husband basically flew off, spun round and landed smack down on his shoulder.

all of this in front on my 12 year old daughter. He somehow managed to hobble down the stairs, where they tried to call him an ambulance, only there was a 6 hour wait so I took him up instead. He was treated relatively quickly (3 hours) and had his shoulder reset and sent home with pain meds.

My hubby had a meeting with the manager to discuss a gesture for the incident and he’s offered…2 months free membership for my husband and 3 free PT sessions.

part of me is insulted by this, it’s something that should never have happened and quite a serious incident that happened in there club. Did the member who left the treadmill on have an induction telling him how to use the equipment correctly etc? Everyone who knows thinks it’s awful what’s happened and David Lloyd should be taking more accountability for what’s happened.

the other part of me thinks I should pipe down and this isn’t the USA where everyone’s dues everyone 😂 I have looked online and a no win no fee case could be between £2k-£48k so I kind of feel David Lloyd aren’t taking it that seriously ☹️ my hubbies going to have up pay for lots of physio now

I’m a gym goer. I’m also quite a good runner.
I’d never just jump on a random treadmill doing 14… and if I did I’d hang on to the sides until I got settled.

she said the previous person left it on no 14., she didn’t say it was still on running.
So yeah I understand it was OFF but left on No14 so when her DH got on, turned it ON, it went straightaway on to no14.

I am quoting the OP directly from the fourth paragraph. Unless you are the OP, you have no better idea than me what she meant, except I am reading the actual words she has written.

So the OP hasn't returned after the initial post but MNHQ bumped it up despite nobody saying it wasn't real...only posts saying that the DH was an idiot not to have checked the treadmill speed first.

Not the gym's fault, but most definitely the DHs fault. I'm very surprised any of them do think it's the gym's fault Confused

Instead of looking online at no win/no fee pay a fee and go and speak to a solicitor about what your rights are. I absolutely think £48k compensation isn't unreasonable for discomfort, loss of earnings and private physiotherapy. NHS physiotherapy has a very long waiting list and the more and earlier you get physiotherapy the less long term effects there will be.

Speak to a properly qualified person, a solicitor who specialises in personal injury claims. Also, if the gym aren't responsible, then maybe the man who left it running is and you might have a case against him.

£48k!
Give over.
If you are slammed into by another driver, need time off work and private physio you don’t even get triple figures these days.
WTH should someone who is injured due to their own idiocy get anything?

Yes, it doesn't matter what speed someone had it on before, if you turn it off, it resets to zero. It's absurd to suggest it goes from 0-14.

So clearly the guy left it running (which is selfish and annoying admittedly but hardly the gym's fault) and the OP's husband was trying to show off and made an absolute tit of himself.

Well if that was what happened David Lloyd are definitely liable as that's extremely dangerous. That's not what the OP says though.

In the nicest possible way OP DL are not to blame.
It's DH's responsibility not to step onto a running treadmill
DH did not need to be right next to your daughter
There was no need to call for an ambulance they have emergency calls to attend

David Lloyd is national and as poor as I personally think they are, they wouldn't buy in gym equipment that defies every safety mechanism installed.

I think the OP is mistaken and also has her eye on a payout that her husband is not entitled to.

ENTIRELY his own fault... like stepping out in front of a bus without looking, its not automatically the busses fault if they cant stop in time when you weren't being careful and its the same here. You have to exercise basic awareness, caution and common sense.

It might be excusable for a child, someone with severe learning difficulties or a dementia patient but an adult 'sound minded' enough to be in charge of a child theres not really any blaming the gym.

Your husband should have noticed the treadmill was moving if he had his wits about him. And he must have approached it the wrong way if he didnt notice.

DL will offer you free PT sessions for anything. The same as guest passes. 2 months free membership is definitely more than they usually offer. I expect it's more of a 'first 2 months free" deal.

I've fallen off a treadmill at DL. Totally my own fault.

I've also seen people running on dynamic mode on a 15 incline, which is an accident waiting to happen.

Without clarity on exactly what happened, it's difficult to say if DL are liable. From the wording in the OP, the DH hopped onto a moving treadmill. I find it hard to believe anyone would do that (unless like an aforementioned circuit). If that's not the case then what did happen?

I have never been on a treadmill that stays on the previous setting once stopped, pretty sure that once you stop and get off it needs to be reset again or started at a slow speed, it’s a safety feature on all treadmills surely?

I don’t see how it’s anyone’s fault, I don’t even see how it actually happened.

How do you even get off a treadmill on level 14? It's not like a smooth step off, youd have to jump your feet on the sides and then jump off? And its not like treadmills arr quiet

Your DH is an idiot. It's not DL fault. If I tried to board a moving train that's my own stupid fault not the train company. P

I can't believe you seriously resurrected this thread from two and a half weeks ago that had completely died a death just to tell people this. I mean has anyone even looked into this preposterous thread? I know I reported it at the time, I'm sure lots of other people did too.

The Gym are not responsible and the fact they offered that is amazing!
Instead maybe the Gym can speak to the gentleman and have him pay to retrain.
Buuuut your aprtner shouldn't just step on. He is also responsible for checking the equipment before using it.
