Accident in gym, pretty annoyed 😕

Bit of a rant, a few weeks ago at our local DL club, my husband suffered a dislocated shoulder. My daughter was having her gym induction and being shown how to use the treadmill, with the gym instructor on the other side. The man using the treadmill on the other side of her stepped off and took his water bottle with him so my husband went to step on his treadmill to be next to my daughter, only the complete twat left his treadmill on level 14!!! My husband basically flew off, spun round and landed smack down on his shoulder.

all of this in front on my 12 year old daughter. He somehow managed to hobble down the stairs, where they tried to call him an ambulance, only there was a 6 hour wait so I took him up instead. He was treated relatively quickly (3 hours) and had his shoulder reset and sent home with pain meds.

My hubby had a meeting with the manager to discuss a gesture for the incident and he’s offered…2 months free membership for my husband and 3 free PT sessions.

part of me is insulted by this, it’s something that should never have happened and quite a serious incident that happened in there club. Did the member who left the treadmill on have an induction telling him how to use the equipment correctly etc? Everyone who knows thinks it’s awful what’s happened and David Lloyd should be taking more accountability for what’s happened.

the other part of me thinks I should pipe down and this isn’t the USA where everyone’s dues everyone 😂 I have looked online and a no win no fee case could be between £2k-£48k so I kind of feel David Lloyd aren’t taking it that seriously ☹️ my hubbies going to have up pay for lots of physio now

Why did he step on a moving treadmill? Bit of an idiot, really.
They’re noisy. He’d have heard it moving at speed. They are very visible. He’d have seen it moving at speed. They also have a digital display which he would also have seen.

What was he thinking? Sorry, this is his own fault.

Don’t treadmills slow down rather than just stop dead? You could try to sue and I’m sure a solicitor would lead you on but be careful and read any contract carefully because no win no fee isn’t always as it seems.

Why does everyone think it was still going? I didn’t read it like that at all. I assume it was off, but set at level 14, so that when the op’s dh started the treadmill up, it was at a much faster pace than he expected.

That aside, wouldn’t you normally check, and put it on the right speed for you, rather than just start it up without looking?

Don’t they normally reset and start quite low? I guess if the previous guy had paused it rather than stopped it, and the DH in-paused it rather than starting it again. But who does that? Then your stats would include someone else’s exercise!

I can’t quite imagine someone stepping of a moving treadmill running at level 14 and your DH innocently just hopping on without realising it was moving 🤨
If he was that close surely he’d seen the man using it, watched him get off while it was running and would have had more sense than to step onto it?

To reiterate what others have said. How did your DH not notice? This is on him for getting on a speeding treadmill. Not the fault of DL. Your DH needs to take some acountability.

Your DH is the twat for getting on a moving treadmill! As a previous poster said, why on earth would he do that at that speed??

The only thing he can claim compo for anyway is financial loss, so if he’s been unable to work and doesn’t get sick pay. I suppose you can try and wrangle physio, but the NHS can provide that?

Sorry this is 100% your husbands fault. He should have been paying attention. People do stupid things. Doesn’t matter if they’ve been told not to they still do. This isn’t the gyms fault at all. He’s already been offered far more compensation than they need to since this wasn’t their fault.
I actually can’t believe someone could be stupid enough to step on a treadmill and not notice it was on!

Behave this is your husbands or the other numbers fault it's not the gym they gave a 'use equipment properly, at your own risk' type clause. Using a treadmill as a shortcut is incorrect equipment use.

Why is it the gym’s fault that he got on a treadmill that was running? Even in the US surely that sort of thing wouldn’t get compensation?
I don’t understand at all why he called an ambulance unless you’re not mentioning something pretty significant. They’re not a taxi service though the level of entitlement fits with wanting money off the gym for his own carelessness.
Also why is he going to spend loads on physio? If there’s a huge waiting list on the NHS one session to get him going with some exercises should be plenty?

I'm genuinely sorry your DH had an accident and got hurt. It must have been very embarrassing too, for him and you DD.

But I fail to see how it is the gym's fault. It was not caused by one of the staff being negligent or the treadmill being faulty. Gym users know that you do a cursory check to make sure a) you know how to use the machine to start with and b) that it is set up safely before you begin.

I have run on a treadmill for years and not been injured. I have even run on our home treadmill and had it abruptly stop due to powercuts, and have still not gone flying like your DH. He must have really not been paying attention.

And your DH did not have a serious injury in the grand scheme of things. I am not dismissing his pain, it probably hurt like hell and will take time to heal. But he didn't break his back or suffer a life-changing injury. Trying to sue the gym seems like a waste of everyone's time.

I would be grateful that he wasn't worse off, and learn from the experience. We all make mistakes. No need to turn it into anything more. Move on.

I think the gym have been more than generous. There are two people at fault for this accident, the one that left the treadmill running and the one that stepped on a moving treadmill!

I have actually seen someone do this at the gym, David Lloyd incidentally. The treadmill was very quiet so I could see why the person wouldn’t notice, however the ones at my branch do have some writing on the belt which you’d see moving.

I think the best way to decide is to think through how the gun could have prevented this. Some kind of “dead man’s key” like a jet ski? That’s not industry standard. I’ve not ever seen it. 1:1 supervision? What would that go to membership fees?
personally I can’t think of anything the gym should have done to prevent this so I’d take the free sessions and membership and use it for rehab.

theyre at my gym. You plug yourself in so if you lose your footing and fall off then the treadmill stops

its quite an easy fix too. They also have something similar for horse cross country in that if you fall off the key opens up a safety vest which inflates quickly

i mean there’s tons of stuff they could do. However surely a level 14 speed would be super noisy?
