To think this could mean the end of brexit?

Now MPs will be able to block it. Could this be the end of this ridiculous brexit? MPs can not vote for something that they think will not be in peoples interest and its very clear the people that voted to brexit would be the ones worse off.

JO'B is doing a fab job on LBC today and most brexiters seem to be happy that it might not go ahead as they were fooled by lies!

Common sense and adherence to UK law. That's what the High Court decision showed us today. Triggering A50 is the biggest decision the UK has had to make in decades. To ignorantly plough on without parliamentary scrutiny would be suicidal. Look at the past four months under May and her Brexit team. No details on a plan, smoke screens and back door secretive deals to satiate foreign motor companies holding the country to ransom.

This ruling marks the closest we have been to 'taking back control' since June.

If you think that this ruling somehow undermines democracy then you are really missing the point.

This decision is not about Brexit no matter how the Brexiter MP's tweet about unelected judges subverting the will of the people. It is a matter of constitutional power that has implications way beyond Brexit. Given that referenda are not binding in the UK can the Government ignore Parliament and implement a referendum decision through the Royal Perogative. The answer today from the High Court is No - we live in a Parliamentary democracy and Parliament has to agree to act, the Goverment does not have the authority to act without Parliament. This is a very good thing.

I can't find anything where the Lords say they won't block what MPs decide? The only thing I can find is a Labour Peer saying the Labour Lords won't block Brexit but that was pre-referendum (and they are a minority in the Lords)

While I'm delighted that the legal challenge has been successful (remainer here), I'm absolutely shocked that the referendum was allowed to take place while there was no law in place to say that outcome of the vote would be legally binding.

Why the fuck didn't David Cameron or someone else think of this before they promised the referendum? This country has been plunged into turmoil for bloody months now and I'm sick of it. What a bloody farce.

This challenge & win, is another nail in the coffin, that only highlights how defunct out political system is.

The Diminishing & Low voter turn out & a blatant distrust in individuals & parties, the lies, broken promises, & celebrity style mud slinging & presentation approach to politics, is not even a laughing matter anymore.

Are you saying that you would only respect a vote if it had 100% turnout with Over 50% voting for one option?

No, soz - it was hearsay!!

It was Stephen Kinnock & others on the Politics Show earlier on today.

They said that the lords had agreed not to block parliament's decision.

I'd like to think it could put a stop to all this nonsense but realistically I can't see it. I keep hearing 'voice of the people' to leave, but in all honesty a decision of this nature - with such far reaching consequences - the good ol' British public (of which I am a member) should not have been able to vote on in its entirety. To truly know what we were voting for, be it stay or leave, required a knowledge base that the majority don't, and didn't have. It's a massively complex mess and I have no idea how it's going to be fixed - sadly, neither do the Government.

I thought the referendum was held to stop the Tory party members moaning about Europe. David Cameron hadn't realised that Leave would get a bigger share of the votes.

As a PP said, this isn't undermining democracy, it's the opposite. The electorate votes in the members of parliament who then, as a whole parliament, vote to enact new laws - acting on behalf of the people who put them there.

The government of the day cannot pass new laws alone, for good reason. The referendum was not binding and anyone who believed it was clearly didn't read up on it.

This is quite literally Parliamentary Sovereignty in action. Just what the Brexiters wanted!

Quite right, MyBonnie the result of the referendum isn't actually legally binding and the government can, legally, completely ignore the result and make their own decision as to whether the result is implemented or not. Pretty much makes a complete mockery of the whole thing.

Add on the facts that the vast majority of people in the UK have no knowledge or idea of what the ramifications of leaving, or staying, come to that, actually are, all the lies that were told by both sides in the run up to the vote and the fact that the government didn't even know what to do in the event of a leave vote and it renders the whole things a complete joke really.

Shouldn't have been held in the first place. That's what we vote the government in for: to make these very difficult decisions.

on the basis people voted for Brexit without the full detail of what that would look like, thank god this is now going to be rightly scrutinised. those of you who voted in favour of Brexit were lied to. Eg There won't be extra money for the NHS, May has admitted that. I hope common sense prevails

Maybe the leave campaign are going to have to dust off that "£350 million a week to the NHS promise" again and retcon the Brexiters
although, let's face it, not many were actually voting for this, it was just a fluffy guise for less palatable views

I think this ruling will trigger a general election. May's position currently is no longer tenable. However, be careful what you wish for, post an early election. Both May and Corbyn are singing from the same hymn sheet when it comes to Europe. It will be messy. No doubt about it.

I voted to remain.

So what's the point of voting any more, if they are going to go against what the people have voted.. Why do a group of white upperclass men get to make the decisions.

We, the public, voted for those people to make decisions that we don't have the expertise to make. It's called democracy. The ref was advisory which meant that we were invited to give an opinion. But the democracy on which our country is built still gives ultimate decision making powers to people we have chosen because we acknowledge that they are best placed to make political decisions.

It would actually be a very bad thing for us and for democracy if there was nothing legally wrong with overlooking input from the people's representatives. The PM would have no check.

In what way were you not lied to. On the basis Farage and co didn't actually give you any hard fact as to what Brexit would mean and then May reneged on the NHS "promise" you voted on the basis of literally nothing

The figure on the side of the bus was never promised to be spent on the NHS. It could be. Never promised that it would be. No lie at all. I'm bemused by this being the main criticism of the leave campaign.

I think the UK might be surprised at how MPs will vote. The UK is leaving, that much is certain. The direction it takes to do this is not so certain. And then the debate begins.

This ruling is merely the preliminaries.

The referendum was created by an act of parliament.

It's own campaign literature contained this phrase

“The referendum on Thursday 23rd June is your chance to decide if we should remain in the European Union."
