You can also get legal aid if you don't work.

I work full time

No she only does part time 19 hours

Presumably she "only does 19 hours" because she does the parenting and looking after the house?

OlderGlaswegianLivingInDevon · 20/06/2024 23:26

There is enough equity in the home to buy you both a house, but you have no money
there is enough equity in the home to buy you both a house, but you are on min wage.

How ?

Hellodarknessmyfriend · 20/06/2024 23:26

@Joke14 Why would she be entitled to legal aid? Unless she qualifies on grounds of dv?

TheShellBeach · 20/06/2024 23:26

I don't understand.
If you work full time you should be able to afford a solicitor.
If you're on a low wage, you should get legal aid.

Joke14 · 20/06/2024 23:26

Yes she always done that I haven't a problem with that though

Yes, something doesn't add up here.

You pay child maintenance?
But you're not divorced yet.

KarateSchnitzel · 20/06/2024 23:29

So since being arrested you have already arranged to rent another house? And arrangements for child maintenance?

I think OPs name may give the game away?

That's why her mum dad wanted me arrested

So someone shouldn’t pay child maintenance until they are divorced? Even though after separating it could take a fair while for the divorce to go through?

RMNofTikTok · 20/06/2024 23:09

100 percent didn’t touch wouldn’t lay a finger on her or any girl. We was shouting at each other

Shouting at someone IS common assault

No it isn’t.

Shouting is only common assault if it is done in such a way as to make the victim think they are about to be attacked.

@TheShellBeach Low earners are not entitled to legal aid if they own property which is regarded as an asset. When I left my ex-husband and he changed the locks within hours on our marital home as "punishment" I was only working one day a week. Didn't qualify for legal aid as I jointly.owned the house. Unless DV can be proven (which can often be almost impossible).

StormingNorman · 20/06/2024 23:32

sprigatito · 20/06/2024 22:19

Do you want to sell your children's home out from under them?

To be fair, plenty of couples sell the house when they split up.

Chickpea17 · 20/06/2024 23:32

Joke14 · 20/06/2024 22:18

She also saying I am not allowed sell the house becaipuse it’s family home

That's not her decision the court would have to make a ruling.

Hellodarknessmyfriend · 20/06/2024 23:34

@StormingNorman How else can he afford to buy/rent somewhere to live?

Would she be classed as a joint owner

If you're both on low incomes how on earth do you have a house with enough equity in it to buy two houses?

Because when I was young I saved alot of money up

If your STBXW has discussed the house with you, why didn't you arrange to see the children?

There was no need to go round to the house if you could just have sorted this out over the phone.

Yes, as you're married.
