To think that if you commit a male crime, you should do male time, even if you identify as a woman?

I know this is a sensitive topic but I’ve been thinking about how justice systems handle trans women who commit serious crimes, especially violent or sexual offences, and whether it’s fair to house them in women’s prisons. To me, if you were born male and commit a crime typically associated with male offenders, particularly one involving violence against women, it seems like common sense that you should serve time in a male facility. Identity doesn’t erase biology or risk in those cases.

AIBU to think fairness and safety, especially for vulnerable female prisoners, should come before ideology?

To be honest I don’t care what crime a man has committed. If imprisoned, he needs to go into male prison, whatever identity he is claiming. If he’s uncomfortable in prison, that is not women’s problem to solve.

Men belong in male prisons, no exceptions. It shouldn't be dependent on their crime or who they identify as.

No, I don’t think that trans women who have been transitioning for years, pass as women etc should be put in a male prison because that would put them in danger. Yes, I think that men pretending to be trans women to get into female prisons should be put in male prisons.

I think there needs to be guidelines on this that will mean things like length of time since the person has transitioned, surgeries, hormones etc are taken into account.

My understanding is that following recent developments in the UK only four trans women are held on the female estate, and all four are being held on a completely separate wing to biological women (I am unclear what their crimes are).

So the issue of male sex offenders being housed with female prisoners is, for now, being dealt with in a pragmatic way that is not exposing female prisoners to danger.

This was not the case a year or two ago, but progress has been made.

There's no passing as a women. All the drugs and surgery in the world will not make a man into a women.

He goes to a male prison, it is not womens problem to solve.

They will never be women and shouldn’t be locked up with female prisoners who are often vulnerable being victims of abuse and male violence themselves. We need to stop this delusion that people can change sex. They can’t. It’s a legal and cosmetic fiction that was once an eccentricity to be tolerated but now has gone too far.

Nonsense. You can always tell they are men and vice versa. They are still men so they belong in male prisons rather than endangering women. You can’t change your sex.

Nope. No men. Not one. However much they’ve tried to alter themselves with drugs and surgery. If they’re in danger in men’s prison,whose fault is that? Why should women be used as human shields for men?

I agree that no one should be sexually assaulted in prison, in your scenario the Trans Woman should be segregated in a male prison for safety reasons, they should not be placed in a female prison.

We see them, we know. A high proportion of trans identified prisoners are actually sex offenders. Several have been housed in the female estate and have assaulted staff and prisoners.
I repeat a man cannot transition to a women.

Surely if you are biologically male and don't want to be in a male prison don't commit offences that put you there? With the way the prison estate is at the moment you've got to really go some to get custody and once you're in your released a lot sooner than previously other than the most serious offences.
I worked and still do albeit less directly now with women in the justice system, those in prison are some of the most vulnerable people you can ever imagine. They need protection. Build a trans prison if you like!

I’d stake my house on there being less than 1% of Male trans prisoners having had their cock and balls removed.
They are almost all Sex offenders to boot.
There should be No Males in Female prisons, ever.

I wouldn't say always, but the number who genuinely pass is going to be small, when seen in person.

Anyway, I've always found it interesting how for a long time the argument was that trans women had to be in women's prisons or they'd kill themselves, but nobody argued that for trans men, iirc it was just 'it's not safe for them in men's prison'.

They carry the male chromosome whether they got rid of the penis or take hormones.
Sorry to be blunt but they are men. Therefore they go to men’s prisons.

There are trans wings of prisons today. No transgender person has to choose men or women. They are literally housed separately.
