I'll keep it short - DM very kindly gifted myself and my brother £50k each, 5 years ago.

She has now asked for it back. My brother has not been asked.

AIBU to say no?

Is there an enormous drip feed coming? Have you got 3.8 mil in the bank while your brother is barely able to pay his mortgage? It feels like some context is not being included.

What could you afford to give back?

What does she need it for?

Why hasn't she asked your brother and is there some way you could both give her back some which would solve whatever the issue is?

Obviously, it isn't reasonable to give a gift and then demand it back again, and you aren't under any obligation to give it back. But I probably would if I could and my mum was in need of it.

Technically yes - I purchased a house, so I could sell it.

I also have some savings, no where near £50k but I could sell my car/get a loan to try and raise the money.

I’d describe that as technically no - you spent it (as would most people)

why does she want it back anyway? Ok I could perhaps understand if she no longer has any money and can’t live, but then why give £50k to each of you

Sorry I did write a longer OP but it got very long winded so I edited - a lot!

She inherited £200k 5 years ago. She kept £100k, and generously gave £50k each to me and my brother.

She wants the money as she wants to move house, downsizing, but to a much more expensive area.

Without knowing if she is now in great need of some money it’s difficult to answer.

However if this is a gift then no you don’t have to repay any of it.

If it was definitely a gift, with no caveats at the time, then it’s tough really. She’ll have to look elsewhere for a home within her budget. She’s being so unreasonable to put you in this position!
