Cheeky fckery

Queenie6655 · 16/07/2021 16:06

Hmmmm I have never come across much cheeky fckery before I must say

But my cousin is taking the fcking biscuit right now

Not heard from him in years
Random call few weeks back to ask if he could help to cut down some trees on my land (we never asked him to do so)

So few weeks later
He has made his way to one of our lovely areas of land with huge tractors - made a total mess

Got a random guy to come cut trees - no idea who he is but he throws his litter on the road every day for us to pick up

Now I would say he has cut down 40 trees
Looks like my cousin is building something and has seen the price of timber so tried to pretend he was doing us a favour

I'm raging with him
He has left such a mess

If I say something my elderly father will get upset but it just pisses me off so much I'm tempted to put a lock on the gate so he can't take the rest of the trees away 🤬🤬🤬🤬🤬
@Queenie6655
Given the size of the trees to make planks and volume, he shouldn’t have cut them without a felling license in place, do you have one

Never mind the impact to the environment and the fact that it is bird nesting season. You need to know these things as a landowner

This^ OP don’t want to worry you further but I would be very surprised if a woodland of 40mature oaks would not have a TPO order or ancient woodland protection order on it . Both need consent to fell. There are huge fines for non compliance.
But I would never have known this at all

I only found out the full story when I got back from working away

Well if you don't want to risk prosecution yourself maybe you need to involve the police now and tell them he did not have your permission to do this.

SmokedGlass · 16/07/2021 18:06

@Queenie6655, all I will say is that if you have to go back to work at anytime soon, I would make sure that anyone who is looking after your father is aware of this guy
God knows what his next move would be if he knows you aren’t around

It is theft, but you actually gave him permission without knowing his intentions, it’s happened now but you have to stand up for yourself, I’m seething on your behalf, he’s a cunning piece of work

I would be also be aware that he could now take even more liberties knowing that you are away

Di11y · 16/07/2021 18:09

If you take the planks back you could hold some to ransom and say once they've tidied up the place they can have x back.

Terhou · 16/07/2021 18:09

If I put the lock on I hope me may take the hint

FFS, don't rely on him taking a hint, just get on and tell him he's not to come back.

Queenie6655 · 16/07/2021 18:09

Ok much appreciated

He’s taken massive advantage of your Dad, as a tree surgeon he will know all this and should’ve acted accordingly. If a licence exists it would be with the farm paperwork I imagine, look for anything from forestry commission or a woodland management plan. It’s a good job you’ve locked the gate, take plenty of pictures for evidence and you have no choice but to confront him.

If you Dad isn’t able to look after his farm properly then it’s time to try and sell it or get a land/farm manger in. Doesn’t sound like you’re in a position to run it, I assume. Ask the farm workers if any, if they know any farm history to help?

Bryterlayter1 · 16/07/2021 18:11

OP, as your father has dementia, this could be viewed by the police as a form of elder abuse, whereby your cousin sought to deliberately mislead your father for his own financial gain. I would report to the police explaining that you thought he was clearing dead trees, you would never have given permission to remove live trees, that he came when you weren't there and knew your father wouldn't understand what was happening, that he stands to make 1000s, etc The police should take this seriously given the mitigating factor of your father being a vulnerable adul.

Jaxhog · 16/07/2021 18:15

Call the police. This is theft surely? You should get those trees back.

Not to mention trespass and criminal damage.

Queenie6655 · 16/07/2021 18:15

We have a man who helps us

He filled me in when it was too late

I trained in tree stuff and always say dont trust tree people, theyre either making up a not needed job or after free wood. Blocks of ash, oak etc can go for thousands

Queenie6655 · 16/07/2021 18:23

Oh my gosh

So he knew the fools to go to

I could never treat anyone this way ever

And to be fair
I doubt my father ever asked him to do anything on this piece of land it is far from the house and he rarely goes there

Has he taken all te wood? Id start talking to him about Tree Protection orders and stuff

GrandmaSteglitszch · 16/07/2021 18:31

@Snog

Now that you do know - take action.
2beesornot2beesthatisthehoney · 16/07/2021 18:32

@Queenie6655
I have given you the links so that you can check the woodland for any designation. Alternatively PM me with the name of the farm snd the location and I can help you search . If there is a designation of any sort I would preempt anything by reporting to the police There was a recent case where the perpetrators got fined and the owner only cautioned due to circumstances like yours .

As far as nesting birds are concerned the Law regarding that only states that it is a crime to disturb nesting birds inorganic destroy an active nest . Depending on what part of the uk you are in most birds would have fledged . It would be a hard thing to prosecute aTBF and I can imagine the police only doing a visit to them and taking no further action .

If there is no designation then it’s just straight forward theft and you can choose whether you went to the police or took matters into your own hands such as retrieving the wood.

Hope this helps

GrandmaSteglitszch · 16/07/2021 18:33

Also, if your dad is the landowner, not you, you didn't have the right to give permission for anything.

2beesornot2beesthatisthehoney · 16/07/2021 18:35

Not sure where that inorganic came from should say or

Queenie6655 · 16/07/2021 18:35

Thank you so so much guys

But he said he had been asked to clear some trees Which turns out to be a lie So I didn't go against my fathers word
OP posts:
picklemewalnuts · 16/07/2021 18:42

Report it to the police- he has no contract to say he had permission to go on the land and fell valuable timber.

You gave him permission to take some trees that he told you had fallen and were causing a blockage.

Queenie6655 · 16/07/2021 18:44

Thank you

My wider family have said the same

So angry now

Thanks a lot

Sadly i agree. This just might be the wake up call
