Can a tier 4 family stay with tier 2 DM?

Help please! Is there a lawyer in the house?

We’ve read the government guidance and have ascertained that we can visit my DM, because we’re in her support bubble, but can we stay overnight? It doesn’t seem to be clear.

No overnight but you can visit each other depending on your criteria for the support bubble

The guidance says tier 4 residents definitely can travel out of their area to visit someone in their support bubble. We are struggling to interpret the part saying whether they can stay overnight or not.

If your family and your DM have formed support bubble (e.g. because she is a lone adult.) Then you are counted as a single household. So can stay.

Assuming the bubble is your DMum (single person, or sole adult in the household) plus your household, then yes you can function as one household including overnight stays.

Also wondering what you mean by 'in' her support bubble - as it implies there are others. In which case you probably need to have her review and reform her (one) permitted bubble. You're not allowed to chop and change

If you are in a support bubble then you can leave tier 4 to visit, and as a support bubble you are essentially one household so you can stay overnight. Government didn't release Tier 4 guidance for a couple of hours after the press conference which didn't help, but Tier 4 guidance is now on there.

I think it's a no. And the longer you're there, the higher the risk of giving it to her and spreading it in her Tier 2 area. Sorry.

Does anyone know if this covers crossing LAs in Scotland? We are an extended household with anothet adult who lives alone but in a different LA. At present one tier 2 and one tier 3 but both will be tier 4 from the 26th.

Yes OP you are allowed to do this. Support bubbles are exempt.

The rules on support bubbles (for lone adults/ single parents) is that you pick one other household to form a bubble with, exclusively.
That bubble is then allowed to stay overnight with each other as they are considered as one household. This supersedes all “Christmas bubble” and tier rules

So, yes, as long as you are her sole bubble then you can go to your DMs

The whole reason we are in tier 4 is to prevent the spread of the new strain spreading outside of the tier 4 area. If you travel out of tier 4 you are potentially spreading Covid into those areas.
As per guidance....

It’s very unlikely you are going to be arrested OP.
At the most you might get a £60 fine. If you’ve isolated for the required time, see your DM she’s a single person household, possibly vulnerable, support bubble etc
Just go.

Support bubbles are exempt.

It is saying you can't stay with anyone OTHER than your household or support bubble. This means you CAN stay overnight with your household and your support bubble.

My understanding is yes, you can stay. You are one household whether in tier 4 or not.
