I am sure he knows that there is every chance that his decision will be overturned in the courts but then he can hold up his hands and say, "Not my fault." You can despise someone's (alleged) crimes, but still respect the rule of law.

In order that the decision to allow her to remain a British citizen is carried out by the judiciary system and not the Government. The HO knew Bangladesh would deny she was their citizen, that she would appeal and it would/will be upheld.
