URGENT arrested but we can’t get any information - what can we do?

DP was called last night by his son to say he’s been arrested, he wasn’t able to say why. He’s called several times today for updates but they can’t/ won’t tell him anything. What on Earth is he supposed to do? Son has previous so he is worried he will be kept in but without knowing what he’s charged with we’ve no real idea. Please can anyone advise?

I don't imagine there's anything he can do until he is released or charged. He will have access to a Solicitor provided by the State and will be interviewed. I assume the Police can hold him for 24 hours while they interview and investigate before CPS decides whether to charge.

He will know why, they will have told him. He’s chosen not to tell your DP why.

Sorry I meant to say of course he knows what he's been arrested for - he would have been told before they read his rights.

At least ring the station and ask if he is still there?! I’m sure they are allowed to reveal that

Have you checked your local court roll? He might have been sent to magistrate this morning?

They can’t tell you anything, for obvious reasons. As frustrating as it is, there’s nothing you do but wait and see.

I’ve been there, it’s awful and so worrying. Sending a hand hold, as I’m aware they may have done something wrong but no matter what it’s an horrid experience for everyone.

If he has previous, wouldn't it be likely to be the same thing again?

I don’t understand any of it, I’ve no experience of this - it wouldn’t surprise me if he was lying. He was supposed to be interviewed today but the duty sergeant no now won’t give any info at all. Where would I find the court register?

Type his name into google or try to ring the court in the morning. It’s public record going to the courts so it’s not secret

Presuming your dp's ds is an adult, then of course they can't give information out about him, to anyone else.

Also, of course he knows why he has been arrested. If he chose not to tell his Dad, then that is his prerogative.

I believe you are only able to hold someone for a certain period of time without actually charging them - then if you want to keep them longer you need to get permission for that but you must have strong grounds

Unless he is vulnerable or under 18 they won't tell you anything. He has chosen not to say unfortunately.
They may tell you if he's still in custody that will be about it. Good luck

They can hold them 24 hours, only keep them if they're getting charged. Then it's either bail at home or remand in prison. If he's not being charged they have to release him after 24 hrs. I assume he's not under 18? He should be allowed another phone call at some point but he will of course have been read his reasons for detainment when checked into the custody suite so he does know.

Yes I’m sure he does know, he’s mid 20s and has form for assault but tbh it could be anything. I know they don’t have to tell us but his dad is going out of his mind not knowing

What did he phone your dp for?

Moral support or to do something practical?

He know what he was arrested for. He will have been told when being arrested and booked in.

But I would be questioning what it was he wanted from your dp at the point he rang.

He probably isn’t allowed to say why he has been arrested as this could hamper their investigations.

He wanted DP to let his (son’s) mother and gf know, obviously he only had 1 call.

He’s an adult. He will have been provided with a solicitor. Charged or released in 24 hours. Probably needs his dad to stand bail ?
