Employer have said I have resigned - I haven't. Urgent help please!

I have a loooong thread in AIBU and received excellent support but things have escalated.

Long story short, I went on maternity leave this time last year. I had issues at work throughout my pregnancy, being shouted at and sidelined and told to move locations. Sorted it all out informally.

In March I asked to return to work early from Mat leave due to financial issues caused by lockdown. At this point my boss attempted to move me again, that didn't work and she then went back on the hours she had given me and it messed up my childcare.

I raised a formal grievance and put a flexible working request in at the same time. The company failed to do anything with my request and the grievance process was mismanaged and a data breach occurred in the middle of it, where my grievance letter was upload to a public file and seen by others.

The grievance was upheld in parts but they again tried to move me to a new location which doesnt work due to childcare issues.

I requested mediation with my boss in order to go back to work as I'm still not back 7 months later.

Today the regional director has said that they won't honour mediation and I have now resigned.

My union rep has disappeared and I received this at 16:00 today so couldn't get hold of ACAS.

Any advice would be very welcome!

I've been lurking/following this thread. Couldn't offer any practical advice but I've been hoping for things to go your way. So pleased for you reading this! Well done for sticking with it.

CharityDingle · 29/06/2021 22:33

Well done!

Justilou1 · 30/06/2021 10:08

Obviously they have things to hide from the tribunal. Good for you!!!

SquashMinusIsShit · 30/06/2021 22:16

Finally you are almost at the end, I can't even remember when your threats started it's been so long.

Echo the balls of steel @Titslikepicassos you are a legend 🏆

Thread moved on a bit @888central

NoWordForFluffy · 01/07/2021 07:46

I have no idea why you'd come onto a thread which is over 900 posts in length and not, at the very least, read all of the OP's posts!

Tits, did you manage to sort the finer details out yet?

tillytown · 01/07/2021 18:24

Does this mean you aren't going to tribunal anymore?

fizzandchips · 02/07/2021 21:14

I’m so pleased for you. You deserve it.

Jux · 03/07/2021 16:31

Lost sight of this thread, so late to congratulate you. I'm so glad they increased their offer. Did you accept it, or are you sticking out for what your solicitor agrees is a reasonable amount?

Quite reasonable to take the offer, the stress has to be brought to an end at some point, doesn't it? It's so hard to live through a thing like this; the employer has no actual skin in the game so can just trog along, while for you it's deeply personal.

CrikeyPeg · 05/07/2021 02:43

Great news Tits! That was indeed the long game but hopefully they have confirmed tax status etc and you wil be sorted very soon. Wine Cake

whynotwhatknot · 07/07/2021 10:14

I cant remember the figure you wanted but well done although i would have liked to see them being dragged over the coals for their behaviour which will just be swept under the carpet

Mix56 · 12/07/2021 08:27

Applause, you have been vindicated. Well done for being so resilient.
I agree that many people would not get this result as no support, savings, income or union.

Justilou1 · 13/07/2021 04:21

Aaaah, so you’re done! So very pleased, @Titslikepicassos!!! I’m thrilled for you, in fact!

Mummyoflittledragon · 13/07/2021 05:39

Just caught up on the thread. That’s such brilliant news. You’ve had absolute nerves of steel to stick this one out! I hope you now have a nursery placement and your studies go well. I’m disgusted to read that you were working in social care, caring for vulnerable kids and this bitch pulled the rug out from under you. She really has no regard for anyone but herself and really shouldn’t be in a role, where her decisions have an impact on vulnerable children. Shame on your ex employer.

BountyIsUnderrated · 13/07/2021 06:36

For the sake of 2k I would just take the money, factoring in solicitors fees and everything.
My mental health would be shot at this point, you have some strength to fight this for so long. Think you deserve a glass of wine lol. Wine

WhySoSensitive · 13/07/2021 07:16

So incredibly invested in this! Pleased you got your hardline figure (if you accepted after your additional info request!)

Hope you find a better workplace soon OP!

fluffygreenmonsterhoody · 13/07/2021 07:24

Well played OP, well played.

MrsPerfect12 · 13/07/2021 07:58

Congratulations. I have followed your story from the beginning and I'm so glad you have stood up to them. Flowers

caughtinanet · 13/07/2021 08:55

I'm glad this popped up again as I'd missed some of your updates. Good news that an acceptable end is in sight

Qwertywertyitsme · 13/07/2021 09:11

I worked for a huge organisation too and during my pregnancy they changed my shift hours from 8am til pm to 2pm til 10pm. They did this
as it was a far less stressful shift so better for me. The only oroblem was that after maternity ended they told me the new shift times would have to stand. When I old them I couldn't possibly find childcare that ended at 10.45pm (time I'd get home) they said it was that if nothing and asked me to answer an honest question. What was more important to me, my job or my baby? I resigned.....still regret to this day not taking it further but it was 20 years ago and I'd just lost my mum

Keep fighting op x

Qwertywertyitsme · 13/07/2021 09:13

Meant to say 8 til 2pm changed to 2pm til 10pm

Ourlady · 13/07/2021 09:23

Ahh brilliant, the end is in sight and bloody well done for not backing down. You've worked so hard to get justice. I admire your tenacity and resilience.

Twoforthree · 13/07/2021 10:14

Excellent update

Lougle · 13/07/2021 10:17

Well done for holding out. I hope it's over soon.
