Employer have said I have resigned - I haven't. Urgent help please!

I have a loooong thread in AIBU and received excellent support but things have escalated.

Long story short, I went on maternity leave this time last year. I had issues at work throughout my pregnancy, being shouted at and sidelined and told to move locations. Sorted it all out informally.

In March I asked to return to work early from Mat leave due to financial issues caused by lockdown. At this point my boss attempted to move me again, that didn't work and she then went back on the hours she had given me and it messed up my childcare.

I raised a formal grievance and put a flexible working request in at the same time. The company failed to do anything with my request and the grievance process was mismanaged and a data breach occurred in the middle of it, where my grievance letter was upload to a public file and seen by others.

The grievance was upheld in parts but they again tried to move me to a new location which doesnt work due to childcare issues.

I requested mediation with my boss in order to go back to work as I'm still not back 7 months later.

Today the regional director has said that they won't honour mediation and I have now resigned.

My union rep has disappeared and I received this at 16:00 today so couldn't get hold of ACAS.

Any advice would be very welcome!

@Cakeofdoom - my solicitor agreed that my bottom line was a reasonable amount. She clearly didn't want me to settle last week but wasn't pushy because she was aware I was struggling with the stress of it all. She was adamant that the company wouldn't come up any higher and was all for going ahead to tribunal. However, I wasn't shocked this morning when their offer increased.

Just an update -

The company have now offered me my bottom line figure.

Just making sure it's tax free and comes with a neutral / positive reference before I make a decision

Oh well done @Titslikepicassos. DH had similar and because of the stress of it all he decided to take it! I think it was tax free too but this was a while ago. 💐 for you x

Having been in a very similar position, I advise to just take it and get rid of the stress. The relief when I finally got the money through was amazing, my world just lifted. Good luck and well done on pushing through so far.

One final tip is to agree the wording of the reference first. I asked for a decent reference and they drafted one which I made them change to suit me, before I signed the agreement. I have never had to use it but I know word for word what it would say and it is part of my legal agreement with them.

Been following and so glad they've offered you your minimum now. What a shit show.

Another tip on top of the excellent reference one would be an agreement for no within industry bad mouthing should you wish to carry on in the industry. My friend went through similar and her solicitor got one of these clauses in. Worked out one of the best things to do as she discovered that while they were providing the agreed reference they were also informally describing her a litigious and she struggled to get another job. The company had quite a shock when someone made the mistake of informing her in writing that they'd turned her down for x reason given by y company.
