Just got this email - on how to request access

Update on Stand With Maya!

This week I finished writing my seventh witness statement in this case, and we assembled the fifth bundle of evidence. My lawyers wrote their fourth opening statement, and I am preparing to be cross-examined for the third time.
I am claiming for compensation for injury to feelings, aggravated damages, lost earnings and future earnings.
The tribunal will be the same panel as before, and the hearing will be online.
If you would like to watch you should email in advance to [email protected]k_ — the email subject should be PUBLIC ACCESS REQUEST - Forstater v CGDE & Ors 2200909/2019 - 21 and 22 March.

Olivia Dobbie is arguing the point that MF's employment difficulties post-CGD were mainly about MF turning herself into a controversial campaigning media/social media figure.

Or join 'beard-combing cab driver man'!

chilling19 · 22/03/2023 10:09

Also, why is Maya being re interrogated? The decision is already made?

OP posts:
chilling19 · 22/03/2023 10:11

Nauticant - ah I see. However, this was as a direct result of her treatment by CDG?

OP posts:

The decision is made but how are the damages to be quantified? To answer that it's necessary to "construct" the nature of the job she lost because that job wasn't defined by contract, and it's necessary to examine the treatment she was subjected to by CGD.

LipbalmOrKnickers · 22/03/2023 10:12

Was just having the same thought @chilling19 . I understand why OD is doing this, but why is she being allowed to?

chilling19 · 22/03/2023 10:13

Hmm, is it the case that tribunals award direct monetary losses plus loss for psychological damage?

OP posts:
LipbalmOrKnickers · 22/03/2023 10:15

Reputational damage maybe - and OD's line seems to be building to the assertion that MF brought it on herself??

nauticant · 22/03/2023 10:15

I understand why OD is doing this, but why is she being allowed to?

It's because there's a dispute as to the seniority of the job that was withdrawn from MF. Because that's a contentious matter then CGD are entitled for this to be argued out in the hearing.

From Citizen's Advice:

If a tribunal decides you’ve been unfairly dismissed, you’ll get compensation. The amount they award you is made up of:
• a fixed sum calculated to a set formula - this is called a ‘basic award’
• compensation for the money you’ve lost as a result of losing your job - this is called a ‘compensatory award’
The tribunal can’t award you compensation for stress or upset caused by being dismissed - unless you’re also claiming discrimination.
The tribunal also can’t award you compensation for the costs or time involved in making a claim unless they decide your employer has behaved so unreasonably in the tribunal that they’ll award you costs as well as compensation.

Additional compensation can be awarded for vicitimisation:

Thank you for your clarity of thinking Nauticant.

As always!

Iamtheredjumper · 22/03/2023 10:19

Omg, I'm mortified. Absolutely not an attempt at disruption, hit the button in error and then couldn't get out of the meeting!

nauticant · 22/03/2023 10:20

I'm really sorry Iamtheredjumper but I am now very amused.

chilling19 · 22/03/2023 10:28

Iamtheredjumper - the software is so clunky!

End of MF's evidence.

Now it's P Mills as witness for CGD.

nauticant · 22/03/2023 11:05

Interesting to see that CGD were representating MF as having a high employee's salary to funders such as The Gates Foundation, but are now saying that she would have been appointed at a much lower salary.

So to resist MF's damages claim in a UK Employment Tribunal, they're effectively acknowledging that they misrepresent the salary component of CGD staff to funders. That doesn't look like a wise thing to do.

Ameanstreakamilewide · 22/03/2023 11:06

Do the English employees not receive any of those 'benefits'?

nauticant · 22/03/2023 11:07

For US employees I'd assume part of the benefits would be very high health insurance.

Ameanstreakamilewide · 22/03/2023 11:12

That's what i thought, but it's a bit rum if the Brits don't get any equivalent.

chilling19 · 22/03/2023 11:14

Ooh, Ben getting razor sharp over the absence of Mr Plant

OP posts:
SpottyBumPony · 22/03/2023 11:14

Mr Cooper on showing his excellent form re Mr Plant

LipbalmOrKnickers · 22/03/2023 11:15

Scathing!

Ameanstreakamilewide · 22/03/2023 11:16

Did MP give evidence last time?

I suspect he was too chicken to do it again, so sent Patsy Mills instead to do his dirty work for him.
