Sandie Peggie: Employment Tribunal, associated legal claims, and related matters - thread #68

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

A second Employment Tribunal, Sandie Peggie vs Royal College of Nursing, has just been heard. The hearing started on Wednesday 23 September 2026 and ended on Thursday 1 October 2026. It is possible that a decision will be handed down before Christmas of this year.

Additional legal claims have been raised. Sandie Peggie is taking action against three senior managers who were witnesses in the first Employment Tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

We have known for over 3000 years, since Greek writers and Hebrew writers (among others, those are just the ones I'm most aware of) that a man, the type that provides sperm, and a woman, the type that provides eggs and gestates and gives birth and feeds, are needed for reproduction. We all know the differences between women and men. A few examples where it's more difficult to tell don't invalidate the definition, but of course those whose whole identity depends on this being complicated try to pull down any definition by saying that this or that exception invalidates it completely. So we have to explain how the definition actually works.

None of this nitpicking makes a man a woman or a woman a man. Most trans people, from a point in puberty, are absolutely clearly male (sperm producers, such as Dr Upton) or female (egg producers, such as Isla Bumba, Esther Davidson, Kate Searle, Sandie Peggie). We don't need to check that they actually produce, or even have the capacity to produce, gametes to be sure which they are, because it is nearly always obvious.

I hope that was polite enough. I'm only human, and I get frustrated when people play dumb or nitpick in order to 'win' an argument.

I sometimes wonder how people think the human race evolved with noone knowing until a week a last Thursday that males made sperm and females made eggs. Did we rely on pure chance to produce offspring both human and in the animals we domesticated and bred?

My cat definitely preferred men. Tart.

Whereas our male rescue cat seems to prefer women. He's fine with DH for brushing and stroking, but come to me for a cuddle and a lie-down.

As I’ve said before on these threads, I presume we all just ran around bashing our nethers randomly into each other until something happened.

Frankly, for me it’s the fact that until 5 minutes ago, none of this was even in question. It reminds me of something I read recently about AI use: it’s as if, a year after automatic doors were invented, your friend insisted that not only could they not open a door with a door knob, but in fact that no one, anywhere in the world, was currently able or had ever been able to open a door with a door knob.

We had fertility investigations coming up for 20 years ago. At no point did they check my sperm count or DHs egg reserves. Should I sue do we think?

So you claim that 'male' and 'female' are distinguishable by the size of gametes, GriseldaandMike?

Female mammals are the ones with the type of body that is formed to produce large gametes, male mammals have bodies of the type that is formed to produce small mobile gametes.

Maybe they're not small gametes, maybe they're just far away....

Blimey. I’ve finally caught up with these threads. Thank you for all the information from the RCN case. I am looking forward to the Union showcasing women’s rights merchandise and flags.

However, all that back and forth with one person is so tedious. It really made me think just how much havoc can be wreaked in an organisation by just one personality disordered transperson!
