Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

A second Employment Tribunal, Sandie Peggie vs Royal College of Nursing, has just been heard. The hearing started on Wednesday 23 September 2026 and ended on Thursday 1 October 2026. It is possible that a decision will be handed down before Christmas of this year.

Additional legal claims have been raised. Sandie Peggie is taking action against three senior managers who were witnesses in the first Employment Tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

The past proceedings were live tweeted by www.x.com/tribunaltweets. Tribunal Tweets are likely to be providing coverage in future proceedings. There's additional information on Tribunal Tweets' substack: www.tribunaltweets.substack.com/.

Exactly, that’s what TRAs think is reasonable, for a woman, perhaps distressed, scared, in pain or all three, to actually have to call out that these men aren’t women, preferably by telling them why it’s so important to them to have a female HCP, and why they asked in the first place. When you see it like that, it’s hard to unsee or handwave away the misogyny and lack of empathy and that’s why I don’t view Upton or his defenders as morally upstanding individuals, despite all the nonsensical gaslighting and fawning people do.

Perhaps it has dawned on the people who have attempted to twist language and what has been admitted by Upton that their position is the opposite to ethical and acceptible.

It has the same roots as those male people who came to FWR and without hesitation declared no sex partners ever needed to know their sex and that consent wasn’t negated by engaging in sex with someone without their knowledge of their sex category. I mean, remember the barrister who announced on national tele in an interview that he had done this and it was not a consent issue.

The complete lack of respect for people while gaslighting others that their position is the one giving respect just opens people up to accept abusive behaviour. There is no way to dismiss this. It is happening.

Some people really have fucked up views on consent and safeguarding and it is not the people saying, actually people do have the right to know or to expect a male person to respect people and not present themselves to a vulnerable patient when the patient has asked for a female doctor.

The use of philosophical theory to dismiss consent is abhorrent.

I do wonder whether we pander to this nonsense too much. Taking seriously randoms who claim that Upton and his cohort of men aren't claiming to have changed sex. Seriously?
Arguing about the word female no longer meaning women.
Let alone the creepy and downright dangerous demands that sex change is applicable to children - including 4 / 5 years olds?

While being very appreciative of the immensely wise and insightful posts from posters on FWR, I do wonder whether repeatedly engaging with this drivel gives those with this disordered thinking the belief that they have ethical and rational arguments? When nothing could be further from the truth.

Just a thought.

I no longer engage I just laugh. As does mushroomcat

And his wee sister lilmushycat too

Great — so it’s anatomy, not chromosomes or gametes. Then a trans woman who’s had surgery is biologically female on your own definition. If you want to say no, you’ll need a different criterion, which is exactly my point: biology hands you several candidates and you’re the one choosing between them.

An inverted penis or internal wound lined with intestinal tissue is NOT a vagina HTH

Soontobe60 · Yesterday 17:43

Lacksie · Yesterday 12:50

Do you mean any doctor who is trans is a disgrace?

No, any doctor who claims to be able to change sex is a disgrace whether they are trans or not. There are many people, including medics, who are trans that also know that they cannot change sex. Not all people who identify as trans are stupid.

Soontobe60 · Yesterday 17:46

Lacksie · Yesterday 13:26

The point is that someone can understand human anatomy perfectly well and still have a different conceptual understanding of what the terms ‘female’ and ‘biologically female’ pick out — that's a question about how we define and apply categories, not something biological facts alone can settle.

Being male or female is not a concept, it’s a reality, one that can never alter. One can be a female who identifies as a man, or a male who identifies as a woman, but that doesn’t mean they actually are.

Not all people who identify as trans are stupid.

but it helps with the cognitive dissonance if critical thinking is poor. You don't have to be stupid to be trans but it helps.

Aha! I think I've finally worked out what pps think defines being male an female.

From a GC/ "sex realist" point of view-
A male is anyone who disagrees with me as I have insight into the universal "female perspective". ☺️

I am a male and I do disagree with you. But you don't even agree with yourself. Your arguments are incoherent. They rely on obfuscation, the manipulation of language. As has been pointed out, when you are unable to refute someone's point, you sometimes resort to childishness. Even a convinced gender identitarian would surely be embarrassed at your lack of logic.

Heggettypeg · Yesterday 18:25

Lacksie · Yesterday 13:37

Nobody’s redefining anything. “Female” is an ordinary word that was applied to people on sight long before anyone knew what a chromosome was — biology didn’t define it, and doesn’t settle it.

There's a significant difference between assuming, from appearance, what the chromosomes etc are likely to be, and believing that appearance, on its own, is sufficient to make a woman.

Most people, naturally enough, make the assumption, because in most cases it will be true. And on discovering that the appearance didn't match the underlying biology, would consider themselves to have made a mistake or have been misled.

If you think that a man who has had his penis amputated, a surgical incision made in his perineum and lined with a skin graft, and who needs to dilate on a daily basis for life in order to prevent the wound from closing now has a vagina then you’re more deluded than I thought.

At bottom, it's just classic cheeky fucker behaviour: i.e. put the other person into a situation where it's socially awkward or daunting to say no.

I'm not sure that arguing with Humpty is all that productive! (I try very hard not to bother now as I don't want to give them the attention!)

Well that will be useful if anyone decides to sue. Also explains why Carol Potter needed to go. She claimed it was nothing to do with the tribunal - aye, right or if that isn't Fife enough awayyego.

They know the buttons to push to get engagement. So very wrong and infuriating in equal measure! And they'll be awake again soon. 😫

Thanks for that.

What an awful shower those NHS people are. What a complete waste of the space they occupy and the money they cost the public.

CriticalCondition · Yesterday 21:55

I look forward to seeing Carol Potter on the stand being called to account by a public inquiry. 😡

Really? In the Bonkers State of Scotland? Like that would ever happen. Although I would love to see it.

CriticalCondition · Yesterday 22:29

I suppose I was thinking of an English public inquiry but good point, they probably wouldn't have jurisdiction to call her and it would never happen in Scotland.
Sad times, genuinely.

The correspondence, released to The Herald under freedom of information law, also shows that Carol Potter, then NHS Fife’s chief executive, was heavily involved in the writing of the statement, weighing in on individual sentences hours before it was published.

See this from the OP:

Additional legal claims have been raised. Sandie Peggie is taking action against three senior managers who were witnesses in the first Employment Tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. It’d be so incredible to have all the witch finder generals actually called to account for their actions, but this is the NHS where those people just fail upwards. It’s too much to hope for but I’m very glad that SP is bringing more sunshine on the ridiculousness of a doctor being incapable of determining someone’s sex. So duplicitous.

NB are we still responding to Lacksie? Getting a bit ‘been there, done that’ now, no?

Helleofabore · Today 05:05

“ NC When I talk about sex I'm talking about bodies that make eggs and sperm

DU I dont agree w you and may use my own language “

This really does highlight the issue, as others have also mentioned now and for years.

If a group redefines language and demands that they can use their very own meanings for existing reference terms, the ability to communicate clearly is lost.

When it comes to safeguarding and consent, this is a crucial failure.

All the gaslighting in the world will not change the material reality that this demand of language destabilisation will lead to harm for both male and female people, but in cases such as this, it is female people at most risk of harm.

And still the gaslighting continues

Thanks for the archive/share token for the Courier. I remember that afternoon being one of the times I saw it evolve online (as in here, not watching tribunal) it was definitely an Elmo fire moment and not to dismiss the awfulness of their intentions, it was also one of the funniest Friday afternoons on here - all hail the Fife red-bull’d squirrels
