Sandie Peggie: Employment Tribunal, associated legal claims, and related matters - thread #67

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

A second Employment Tribunal, Sandie Peggie vs Royal College of Nursing, has just been heard. The hearing started on Wednesday 23 September 2026 and ended on Thursday 1 October 2026. It is possible that a decision will be handed down before Christmas of this year.

Additional legal claims have been raised. Sandie Peggie is taking action against three senior managers who were witnesses in the first Employment Tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

The only thing that impressed me about Dr Upton was when he (as was) became Warhammer Champion at Madras as a neckbeard (affectionate term for young men with unconvincing facial hair).

Being champion Warhammerer at Madras, definitely in the top three high schools in the Kingdom, as a callow youth, is a great achievement.

Dr Upton's more recent exploits, have sadly not impressed me. Rather the opposite, I'm afraid.

Interesting @BinturongsSmellOfPopcorn my mind did wander in an Antipodean direction and remembered Howse was from there but I couldn’t be arsed to remember all his name changes to check!

Me too.

Yes, I think exactly so - the oats in ReadyBrek were pre-cooked, just like the potatoes in Smash. NB porridge oats are pre-cooked too, so there's no contradiction in making your own RB from porridge oats.

I like smash, but for anything involving oats I like to start with the groats! As a student, though, I remember finding ReadyBrek or equivalent very handy.

Re the threads, honestly I wonder if the thing to do, @nauticant , might be not to start a new thread until something SP related happens.

This is so wrong, and an affront to the dignity of my childhood favourite hot oat breakfast cereal, that turned me into a bona fide Centrally Heated Kid™️

Ready brek/porridge oats are partially cooked by steaming, but Smash was fully cooked and emulsified mash that was dehydrated after full gloopification. Smash was advertised by metal aliens who were laughing at us!

In the interest of science and justice I am going to have to make some porridge, let it set rock hard in the pan, and then grind it in my Kenwood Chef to make the actual porridge equivalent of Smash.

Just call me LacksieReadyBrek from now on because I won't be able to let this go!

I remember having hot milk and brown sugar on my Shredded Wheat as a child. These were the large biscuits.

KeepupKardigans · 04/10/2026 16:13

Weetabix and Tunnocks, where to start. The shop at RUH Bath have original Tunnocks : tea cakes, caramel wafers, mini caramel wafers( bit more choclaty) some sort of mini wafer with coconut and big buckets of something Tunnocky, cheered me up no end after my appointment. If Tunnocks can separately accommodate a variety of persuasions and tastes and clearly label so you know what you are getting then surely we can have sss as in single biological-sex spaces. Perhaps they should be labelled sb-ss .
Well as to Weetabix, I have mine dry with butter, shock horror I know.

Smash, corned beef, peas and ketchup.

Is that with your readybrek or on weetabix?

Me too.

Me as well. To be fair, there's a limited range of arguments to justify men accessing women undressing etc. Male supremacy, outing & sadness covering most of them. So it's possible that the small number of posters who take up an in inordinate amount of posts on a thread will keep recycling the usual predatory male demands.
Edited to add that in this comment I'm ignoring the recipes and bigly letter posts 😀

You could use a needle and poke the dots? I think it might just work for one message though....

Nah, Ready brek is ⅔ oats and ⅓ oat flour. That's why you can make it into cement a deliciously thick mixture.

I like my porridge so you can chop it into sections, floating in the milk like a castle with a moat.

Readybrek. Just don’t breathe it in when it’s dry. Glues your airways.

When one of my DS first learned to whistle, he would never stop. Ever. Even when pouring his bowl of ReadyBrek. Clouds of UPF oat dust every morning.

Section 71 and its predecessors have historically been used mainly to prosecute gay men hooking up in public lavatories. A man being in a woman's toilet is unlikely to be an offence under this heading unless he is also guilty of some other offence such as exposure or voyeurism. If he were to masturbate without exposing himself, that would be an offence under this section but, if he is in the ladies, that is likely to also be voyeurism. So I think the only way a man in the ladies gets prosecuted for this offence alone would be if he engaged in consensual sexual activity. Passionate kissing may qualify, heavy petting should qualify.

However, a man in the women's is more likely to be prosecuted for voyeurism and/or exhibitionism.

Would the Public Order Act apply to men insisting on using women's single sex facilities, esp after the SC made it clear that sex=biological sex?

The Public Order Act 1986 'behaviour likely to cause harassment/alarm/distress' (s.5)

MarieDeGournay · 04/10/2026 17:21

On reflection - does the POA86 only apply in public spaces? So not inside a building?
But it might apply to public toilets open to the general public - not that there are many of those left😒

Me too! Now I realise why their fervent declarations of "okay, I'm off to raise to my kids now, byee! xx" when other posters ask them to clarify their misogynistic talking points, sounds so familiar.

Keeptoiletssafe · 04/10/2026 17:24

Others and I filled 1000 posts with Howse very quickly once. He stopped answering me on there too. Australia are introducing more unisex private toilets 50% of all new ones in fact. No risk assessment on design differences of course. If anyone wants to do a live experiment - it’s happening there. I think he said he was in South Australia?

I bet him I could find some info on males targeting females in toilets. I picked Melbourne and top story was a male doctor who put hidden cameras in private staff toilets and changing rooms filming over 400 women. Male doctors have a thing for hidden cameras in private toilets. There’s been some nasty cases here too, the worse one in London. Never come across a female doctor doing this.

The Public Order Act 1986 applies to any public setting, even if it is inside a privately owned building. The exception is that no Section 5 offense is committed if both parties are inside a residential dwelling.

Section 87 of POA86 covers harassment, alarm and distress. That particular section applies in both public and private spaces (but not private houses). Men insisting on inserting themselves into single sex spaces for women could potentially be found guilty of a public order offence provided the courts could be convinced that their behaviour was threatening, abusive or disorderly.

So are we saying that a man entering a woman only single sex space including changing rooms at a workplace COULD be charged with a public order offence as per the SCJ? Or would that not work in a "staff only" situation like nurses changing rooms as that wouldn't be considered public?

I think it's worth looking at as currently only the providers of the space - the employers - are considered as breaking the law. I do feel we need to find a way of prosecuting the actual transgressor. That might focus some minds.

Oh yes! That is, IMO, the only way to eat porridge .

(With a bit of brown sugar on top). 😀
