Just listening to a space on X about this. The answer is yes - apparently gender identity can be self id and trumps sex.
(That's what I am picking up anyway)

Although I guess this is a similar trajectory so far to FWS's SC ruling. I just can't understand how people can be such liars, at so much peril to women and girls.

If you need to drag a woman into court to prove you're a woman, if you need judges to declare you one, you're not one. He's only able to bring this case because he's a man!

Men aren't women, Jason isn't a woman, literally everyone knows it and that's exactly how they would understand whom to vaporise. I don’t know about Australia, but here in the UK I have experience of this. I volunteer for a small charity. We had lawyers act for us for minimal cost to us. But of course they had costs they would normally have charged for time etc. When we won our case we were awarded costs and the lawyers were able to claim normal costs for the things they were willing to do for us for a fraction of normal cost.

I think the point is that just because you will help what you believe is a good cause doesn’t mean that you don’t actually have reasonable costs. And while you wouldn’t charge them to someone you support, if the legal system thinks an award of costs is appropriate, you are owed for your time.

Sadly in this case it has gone against Sal this time.

Deep down, I think i already knew that…it’s just the downright unfairness of it.
Talk about kick a woman while she’s down…

So, all of the costs money goes to his lawyers, is that right?

Disappointing, although unsurprising from what people have been saying about the law in Oz. The suggestion that the High Court has some scope to question the law itself is encouraging - does anyone know any more about this?

It really is very demoralising, though. I think I'm right in saying that the Giggle app included advertising room shares of some kind? That's the kind of thing that really shows the illogicality and injustice of this: women are disadvantaged - and put at risk! - in a way men simply aren't when they can't know that "women only" means "women only". Or, worse, women are misled into thinking something is safer than it actually is.

Yes. He's the one who initiated the case, but it's effectively strategic litigation for our side, kind of like GLP cases over here.

My recollection is that Sal said she expected it to reach the High Court, at which point they have to start ruling on international law.

And what this neglected to consider is the concurrent damage done to public trust and faith in politics, democracy, and rule of law.

One could quite easily predict what happens when the government rules that up is down and black is white and forces people to chant the mantras.

It's not good.

"It is important to emphasise that the issues for determination by the court involve the construction and application of provisions of the (Sex Discrimination Act)," they said. "The desirability or otherwise of that law is not a matter open to this court to consider."

Justice Bromwich said Ms Grover's argument that sex referred to a person's sex at birth conflicted with a "long history" of court decisions going back three decades which "establish that in its ordinary meaning, sex is changeable".

This is devastating, I’m so appalled. I was dreaming Sal had won and she was giving a great speech. I was so sure it was true when I woke up. Logged into X to find the worst news.

I’ve had very happy times in Australia when I was younger. Now I never want to go there again.

What a bloody awful place for women. Female sports will die a death - there is already a female football team with five male players. Teams who don’t want to play them for fear of injury are punished.
Women can’t exclude men from breastfeeding groups and breastfeeding advisors must facilitate child abuse by advising men who want to use babies to feed their fetish. Lesbians have no rights to exclude men.

So much more I don’t have the energy to list.

But as Sal has said. In a way not much has changed. These men are still men. Vile perverted men.

That's why some of our GC lawyers say the GRA actually saved the UK. We kept sex and gender separate.
Sal said she knew this wouldn't be the end because, whatever the verdict, the other side would appeal, but it is gut-wrenching for us so must be far, far worse for her.

Scarily, I think this might be the whole point of the exercise. If they can change laws to reflect a blatant lie, then what's to stop them taking further rights away under dubious claims?

Ireland is in the same boat. Our government snuck in a change in legalisation in 2015 with the Gender recognition act, equating 'sex' with 'gender'. Effectively Irish women have no rights in law to single sex spaces.
This technique was actually cited in the Dentons report as a way to change the law with minimum public knowledge or interference.
The report advises NGOs to “Tie your campaign to more popular reform
In Ireland, Denmark and Norway, changes to the law on legal gender recognition were put through at the same time as other more popular reforms such as marriage equality legislation. This provided a veil of protection, particularly in Ireland, where marriage equality was strongly supported, but gender identity remained a more difficult issue to win public support for.” (emphasis added)..

We're going to need a test case that will go through the courts as well. Gutted for Sall G and the women of Australia..
