At this point it's just a farce. Man goes to whack woman with a broken umbrella, woman defends herself, man goes to police to complain that she broke said umbrella despite video evidence to the contrary, police somehow think that this is a valuable use of their time.

The last time I had contact with the police I was on 999 reporting something urgent. I remember feeling quite interrogated about precisely who I was, what I was doing in the vicinity and why I was calling, all before they got to actually taking any details of the live incident.

Every time this sort of bullshit claim happens, I am shocked at the brass neck of someone who seriously calls to log it and how they look themselves in the mirror afterwards, after being such a colossal waste of time. How on earth they don't turn inside out in pure embarrassment while making the report is a mystery.

It worries me that someone complains to the police about something minor, then the police make a formal accusation, then there's a stushie in the press and MSPs publish letters about it... and then the police have a think about whether to proceed with the accusation or not.

If umbrella bloke had been waved his brolly at someone who wasn't as well connected and determined and high profile as Susan Smith - what then?

I just don't feel that this how policing is supposed to work.

Yes - I think the Crown Office and Procurator Fiscal Service still have to decide that the case is worth prosecuting, and I can't see how they can decide that it is anything other than ridiculous.

But how many people are accepting cautions for ridiculous 'crimes' because they don't want to risk the expense of a court case?

I believe the first time she just moved the spike to one side, and the second time gently touched the outside. Nowhere near the broken bit, didn't break it, it was broken anyway and he needs to get a new one because it looks ridiculous.

The MO of these people is to goad and intimidate women to the point where they react in self defence.

It's completely deliberate, and anyone with eyes can see it.

The media needs to pick it up, give it a snappy name, and get it out there.

Also, at least three of those people are friends with noted MSPs. So I have no doubt they are also emboldened by the fact certain MSPs are supporting their cause. I imagine one (or more) of those MSPs are pushing for Susan to be punished.

Nope hes funded by the Scottish government through its arts council programme and even got a hardship grant from them.
So in reality what we have is a government funded misogynistic anti women bully trying to prevent women from protesting the government's illegal policies and being protected by parliamentary police who refuse to deal with his illegal tactics and then using the same police to bully intimidate threaten and attempt to criminalise a woman who beat the government in crt.
Yes things really are that dystopian in Scotland

I don't think they could record a hate crime? The hate crime has to be an extension to an existing crime so if there's no crime then there's no hate crime. Hate speech would be recorded but as far as I know she hasn't been accused of hate speech (AFAIK, though maybe she should do a Subject Access Request to make sure)

But the law is quite confusing, especially as it's different in Scotland and England, so I might have got that wrong.

In Scotland a hate crime is a stand alone offence, there doesn't need to be an underlying crime, hurtful words can get you jailed and its a perception based system aswell.
Oh and anyone can report you your words don't even have to be directed at the person reporting you.
