NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #54

nauticant · 28/09/2025 18:51

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

Access to view the second part of the hearing remotely was obtainable by sending an email request to: [email protected].

The hearing was live tweeted by x.com/tribunaltweets and there's additional information here: tribunaltweets.substack.com/p/peggie-vs-fife-health-board-and-dr-005 and tribunaltweets.substack.com/p/peggie-vs-fife-health-board-and-dr-bd6. Thanks yet again for your absolutely sterling work on this mammoth thread @nauticant You can't possibly have imagined what you were letting yourself in for when you started it. Brava! 💐

Redshoeblueshoe · 20/11/2025 18:27

Thread 55. Nauticant you deserve a special award. Thanks for your dedication.
I'm hoping it's tomorrow.

A while back I was thinking that this was quite something but then someone pointed me in the direction of The Archers threads:

I fear I'll never catch up.

But 74 years of The Archers has absolutely nothing on this.

@nauticant Amazing work with all the thread management.

Not sure if you’ve seen what’s afoot on the Belfast Film Festival threads with everyone name changing and granting themselves titles, awards and more (following the not-quite-recusal of a tribunal panellist for being a fake professor) but you definitely need to get in on the action.

Based on your sterling work, it’s got to be a Lifetime Achievement Award or similar ❤️ 💐 🍾

SirChenjins · 20/11/2025 20:11

Agree with everyone else - these threads have been a fantastic achievement, you've done so well to capture everything and keep the discussion lively but on track. If MN gave awards you'd get the top one 👏👏👏

There's still the 2nd tribunal and any appeals yet so you might just get there yet 🤣

Contemporaneouslyagog · 20/11/2025 21:34

I can't believe I've read all these threads , so much information and wit

CriticalCondition · 20/11/2025 21:39

Thank you, @nauticant. A huge thank you. 💐

Not sure that's strictly true is it? I've been with NHSS for 32 years, paid into my NHS pension since the start, but 60 isn't the normal retirement age - I'd lose a chunk if I took it then.

The NRA for the 1995 scheme is 60 retirement at 55 possible with actuarial reduction of 5% per year but in the fine tradition of the NHS she may well be appointed on a board in some capacity elsewhere 🙄

nauticant · 20/11/2025 22:07

You give me hope@Hoardasurass.

Like someone said many threads ago, if it really continues on and on and on it will be something great to pass on to my heirs.

I think they're simply going by the rule-of-thumb of 3 months. So, hearing ends on 2 September so +3 months = 2 December which is both "next month" and "just weeks away".

There's nothing to say that the judgment won't be handed down after Christmas. Hopefully not though.

The anticipation is killing me.

We're a bit dry on the tribunal front at the minute aren't we

Is it Bleak House that centres around Jarndyce vs Jarndyce?

ProfessorOfAllTheThings · 21/11/2025 07:37

Does anyone else have a little refresh on the Employment Tribunals page?

I have spent far too long on ET stuff in the last few weeks already but there are some decisions that I really want to read now....

All of @nauticant 's loved one gather round for the reading of her will after her sad passing muttering 'not me, oh god please don't make it me'

CarefulN0w · 21/11/2025 09:43

If Carol Potter has had to step down because of the outcome, would it be very mean to predict that other CEOs might find reason to rapidly implement the SC judgement, and will not, after all, need guidance from the EHRC?

To misquote St Ben of Cooper, I think it would be unkind of us to ask how this is working out for various CEOs, heads of organisations and DEI flunkies.

Yes it was. And everything was absorbed by costs, so let's hope that doesn't happen here (for Sandie, obvs. Fife deserve everything they get for the amount of public cash they've spent defending a position they later relinquished Hmm )

Couldn't she tag team with Ben Cooper?

NoBinturongsHereMate · 21/11/2025 11:10

And Akua Reindorf.

NoBinturongsHereMate · 21/11/2025 11:11

There is another one coming up in December, but I'm drawing a complete blank about what it is.

lcakethereforeIam · 21/11/2025 11:27

Is Glinner's due back in court? The 'phone one. Or is that just waiting for the judgement?

ProfessorIDareSay · 21/11/2025 11:33

Judgement next week, 25th iirc.
