NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #54

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

Ooooo. I’m curious about what the people involved in Fife think about this. Quite clearly people like Kate Searle were very confident in their position at the time, I wonder if she holds that same confidence now.

In fact, I’d love to know what the top bosses at Fife really think about this. It comes across like no one involved is even speaking to each other, eg contradictory media comms vs tribunal statements. This is exactly why I feel public sector workers are generally inept.

It seems most unfortunate timing. Yesterday the Judge referred to Jane Russell's negligence. Today NHS Fife publishes a ruling which confirms what we have known all along, that there are only two sexes. Kate Searle, Maggie Currer, Esther Davidson and Isla Bumba have been shown up as complete fools. If they ever really did think they couldn't tell the difference between men and women, that is.

Yes, the journalist has got the wrong end of the stick. Fife's attempt to amend their pleadings to specifically argue that SP's manifestation of her gender critical beliefs was unacceptable has been rejected, but the tribunal has been clear that the issue is on the table anyway and will be considered.

This has to be embarrassing for Isla Bumba. I can’t imagine she would be seen as credible at work anymore, given a lot of this contradicts the evidence she provided and her approach throughout the process. I imagine she would have been involved with drafting this, surely? That must sting.

Now that NHS Fife has aligned itself with the law, I am left to wonder...

If the men-who-claim-to-be-women moan about using the toilets that align with their natal birth at, must they do it in a certain manner?

Are they not risking being told they are objectionably manifesting their beliefs before being thrown to the tribunal wolves?
