NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #54

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

Access to view the second part of the hearing remotely was obtainable by sending an email request to: [email protected].

Anyone seen Scottish Herald? Apparently NHS Fife briefing SNP Govt about SP.

"Sandie Peggie lawyers alarmed"

Uh-oh

NoWordForFluffy · 23/10/2025 08:52

You're misunderstanding what Red is saying. She's saying that it's so easy to get a RADAR key that making access to accessible toilets dependent on one wouldn't stop people who didn't need to use them from doing so.

This

RedToothBrush · 23/10/2025 14:22

My problem is that a radar key ALREADY does not stop abuse of services that require a radar key. I have first hand experience of this (I was not impressed. Person offering is increasingly proving themselves to be a piss taking grifter who has no respect for the impact their behaviour has on others). Also see abuse of sunflower lanyards (yep same person has)

Did you know that the words

'Decline Guide' are an anagram for 'Due Diligence'.

Nope. I didn't.

But then there's no irony in this for me. Unlike NHS Fife and the Scottish Government.

If the report is accurate, that looks like a clear breach of GDPR.

Another? I've lost count.

What is wrong with these people 🤦‍♀️

SlackJawedDisbeliefXY · 23/10/2025 17:57

Sounds like Fife moved the intern who dealt with press releases to a new position to keep them out of trouble ..

They also said Ms Peggie should have had the “skills and knowledge to de-escalate or remove herself from this situation”.

Not sure why this was her responsibility and not Dr Upton's, but as far as I understand, it was Ms Peggie's repeated attempts to 'de-escalate' and 'remove herself from the situation' that led to her being written up in Dr Upton's notes.

I'm thoroughly enjoying a book at the moment that describes how trauma can lead to fawning in every day life to produce a feeling of safety and connection even when situations don't call for it. it's usually recognised as people pleasing a

Often fawning is the safest and sanest thing a woman can do if in danger. Eg placate the person who may harm them until they can get away. Fight and flight would be useless in many danger situations we find ourselves in.

It becomes a maladaptive strategy that the nervous system automatically can select in situations where there is no danger and it something I would like to learn to stop doing as overall it is detrimental.

Fawning and placating is essentially what they are saying Sandie should have done when they talk about using her skills to de-escalate the situation. The court already established that no other response would have been acceptable to Upton.

PoppySeedBagelRedux · 23/10/2025 18:29

There seems to have been a lot of economy with the actualité in that briefing, no?

Exactly. She had the right to be there. De-escalate? Why? Why couldn't he be the one to de-escalate? Why should she have removed herself? But Dr U wasn't happy if/when she did. And she had menstrual flooding (which shouldn't have been relevant to the case of course, it's quite black/white to me without having to know her personal details) - was she supposed to stand in the corridor covered in blood waiting for Dr U to finish?

lcakethereforeIam · 23/10/2025 20:11

So typical. The beaten woman told you must have said something, why do you argue with him? The raped woman asked what she was wearing, what was she doing there at that time? Same old, same old.

weegielass · 23/10/2025 20:12

how many legal cases does Sandie Peggie have going now? I think they just keep piling up as NHS Fife fucks up more and more....

Bannedontherun · 23/10/2025 20:13

Devil if you do devil if you don’t

in NHSF Peggie challenged Uppity look what happened there

In the Darlington case defence asked if the claimants spoke to Rose about the situation

in leonardo she was at pains not to name or challenge individuals, a defence argument being she was not really bothered it was just ideological.

Males excuses as a defence writ large

Dogandcatmum · 23/10/2025 21:11

Interesting. I had to complain to staff at John Lewis Oxford Street this summer. There was a guy, in the 5th floor mixed sex toilets, with his trousers down displaying a full moon whilst standing and peeing in a cubicle with the door wide open.

Do men leave the doors open when they use the cubicles in the men's SS toilets? My husband says "never in my experience".

I wonder what he thinks flies are for.... That is deliberate exposure, I feel, though not of the genitals.

In mixed sex toilets in France there were several men peeing with the doors open and their bums hanging out. DH said it was total unnecessary exhibitionism. So uncomfortable as a woman to use those toilets. No way could I have let DD go on her own.

At least three - Fife 1 (feat. Upton); Fife 2 (feat. Searle and Davidson IIRC); RCN.

Agree with your DH. I have never seen a man with his bum hanging out in a loo in the UK. Absolutely no need for it.

I have, once. The man appeared to have Down's syndrome, and all the other men ignored the surprising behaviour.

moto748e · 24/10/2025 01:11

Well, fair enough, in a men's toilet, in the UK. But in France, it seems the situation is different.

She's got some strength 💪 go Sandie.
And thank God for her amazing backer. Never forget there's someone putting their own hard earned cash into this.
