In a landmark hearing at the NZ Human Rights Review Tribunal, the question of whether it is hateful and harmful to say that men can’t be lesbians is under scrutiny. No, the truth is not hateful

This LAVA vs Wellington Pride case is NZ’s Maya Forstater case.

Ridiculous.
But yes, apparently facts are hateful.
They hurt the fee-fees.

RedToothBrush · 01/08/2025 22:01

Of course it fucking isn't.

Dimwits who say it is, need to start actually living in the real world.

huuskymam · 01/08/2025 22:02

No it's a fact.

LeavesOnTrees · 01/08/2025 22:03

Science isn't a democracy.

Cattery · 01/08/2025 22:04

No. Because they can’t. The end.

Interesting. Is it in session now?

I hope they decide no

Be kind, OP. 😆

The TransActual website has information about transphobia:

https://transactual.org.uk/transphobia/

I picked out a few highlights:

The denial of self-determination ... constitutes transphobia. For example the denial that trans women are women, trans men are men and that non-binary people’s identities are valid and should be respected

Using biological essentialism to try and delegitimise trans people....[is transphobia]

“Man”, “Woman” and “Non-binary person” are social/cultural statuses. Trans people have existed for millennia throughout history and in every part of the world. Consequently, trans people have as much right to claim their genders based on biology or otherwise as cis people do. The Endocrine Society states that there is “a durable biological underpinning to gender identity”. That being said, bio-essentialism plays into the hands of extreme right-wing ideologies.

Deliberate misgendering ... is abuse. Calling trans women, “men” or trans men “women”, or non-binary people “men” or “women” is transphobia. Using the wrong pronouns, such as “she” for trans men and “he” for trans women is misgendering. Not using “they/them” (or similar) pronouns for non-binary people is transphobic as is using these terms for binary trans people.

Treating trans people any differently from those who are also the same gender is transphobia. For example, treating trans women as different from cis women is discrimination and has been defined as such in the UK’s Equality Act (2010).

I emboldened my favourite bits. So I guess the answer to OP is ...yes?

No explanation. Just, because we said so.

BCBird · 01/08/2025 22:39

It's fact

dementedpixie · 01/08/2025 22:39

Where in the Equality Act does it say treating transwomen differently from women (no need for the cis) is discrimination?

I dont have a gender identity. I was born female and so I am a woman. Transwomen are born male and therefore cannot be women

BundleBoogie · 01/08/2025 22:42

I’d say it’s as hateful as stating that the world is round.

Testerical · 01/08/2025 22:43

Of course people cannot ever change sex. You can’t change what gamete-producing organs you have.

as for whether saying a man can never be a lesbian is “hateful”, just absolutely no. I imagine people who object to this are lesbians who aren’t interested in male - genes/ bodied persons. Which is 100% fine.

If a male wants to call himself a lesbian and his lesbian partner also says she is a lesbian, then they can knock themselves out. Just don’t expect a free pass to all lesbian events and spaces, because some aren’t interested in male born people, however they identify.

Sating you don’t fancy someone, or that they aren’t in your sexual crosshairs isn’t hateful. It’s completely fine. Anyone telling you who you should fancy or accept into your community, well, they are the dictatorial ones.

LoudlyProudlyHorrid · 01/08/2025 22:47

When I was a lot kinder than now, I thought everyone was on the same page, that no one could change sex, then I heard TWAW for the first time and it made me think hang on ... Maybe we're not all making a polite pretense here. My mind was a bit blown.
I don't think it's hateful to not be able to make your mind jump through enough hoops to convince yourself that people can change sex.

nbartist · 02/08/2025 00:45

No, I don't think the basic statement that humans can't change sex is hateful at all, and I say this as someone who identifies as non-binary. If we could physically change sex there wouldn't be such a problem!

Myalternate · 02/08/2025 01:17

Trans People are just opting out of their biological sex.
They cannot claim to then become the opposite biological sex as they have absolutely no knowledge whatsoever of what it actually is.

Face lift surgeries to appear younger won’t alter the fact those people will continue to age as nature intended.

You can’t make a silk purse out of a sow’s ear.

Though apparently you can make a not really fully functional pouch vagina out of an inside out penis .

Enough4me · 02/08/2025 01:30

We're simply stuck with the sex we were conceived as whether we like it or not.

A rose by any other name… the inside out penis, will just always be, an inside out penis.

Meadowfinch · 02/08/2025 01:49

No, of course not. Basic scientific fact is not hurtful. No sane adult would want to live their life in a game of the emperor's new clothes.

Whatisthisdamnednonsense · 02/08/2025 01:49

Facts cannot be hateful. Facts are objective eg the earth moves around the sun. Hateful is used to describe a subjective response to something.

AloeVeraAloeFred · 02/08/2025 01:52

How about erasure of the biological reality of human sex = misogyny

Oh yes, misogyny doesn't matter because it's just about silly women. I forgot!

Brainworm · 02/08/2025 08:29

As with many things, context is everything.

Saying humans can’t change sex is a fact. Whilst facts are neutral, they can be stated in an interaction that is motivated by hateful intent, positive intent or benign intent.

It is ludicrous to suggest that the statement itself is hateful, but not that the fact could be used in a hateful way. This applies to pretty much everything. Actions typically perceived as inherently kind, like smiling, could be hateful (e.g smiling when someone is clearly suffering).
