Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

This is at least the first time anyone has come forward saying they've heard Sandie say anything bigoted. It's massive. Unsurprisingly they holding their best card til last.

It isn't the first time, quite a few of their witnesses have said that they heard 2nd or 3rd hand hearsay. None of them heard it directly. Except this one and she can't remember, just described it as derogatory.

This witness has said she heard SP say derogatory things about immigrants and specifically quoted her saying she wanted to post bacon into the letterbox of a mosque.

That's grossly offensive and I don't think it helps anything to pretend these are the same second and third-hand comments mentioned earlier. This person is saying SP said them within her earshot. I don't think Sandie's rights in the CR depended on her having good opinions about immigration or race, so my opinion of her case stands, but it's not fair to pile these into the 'hearsay' group.

The details of exactly when Sandie Peggie will give additional evidence have yet to be unveiled, but given that Employment Judge Sandy Kemp wants all evidence to be concluded by 4pm tomorrow, it'll have to be this afternoon or tomorrow.

Sandie is in her 50s working in the modern day with patients from a wide range of ethnicities. There has been no suggestion that she treats anyone poorly because of their race. Yet everyone is talking as if shes alf garnetts in the 1960.

Yes, she seems to share in what are now quite commonly held views amongst many...regarding illegal immigration, housing, benefits etc She's not a highly educated, middle class person and expresses herself in a manner typical of others from a similar background.

Yes, my DH made an interesting point.

He said 'of course the tribunal judges want you to report, you are actually showing the public what they do, how interesting, challenging, important it is. Being an employment judge is like owning cats. High court, criminal judges get all the publicity - like when you take your dogs out for walks everyone can see them. But people who have cats need to post photos and videos of them on line'

He then went on to talk about the relative proportion of cat, dog and rabbit content on line and I stopped listening. But the first part was good.

That's very insightful about people sharing pictures of their cats too!

Loads of racists must work at these institutions, I don’t think it would be a massive deal. But SP’s reputation would be ruined by virtue of bringing this tribunal claim - I can’t imagine many employers of nurses would want to hire any tribunal claimant due to risk, especially as the NHS is the biggest employer of nurses and they are the respondent in this case.

I think being falsely thought of as a racist is a massive deal. 🤷🏻‍♀️

any potential recruiting NHS trusts have nothing to worry about with regards to a future further tribunal as long as they abide by employment law. Which shouldn’t be hard for a decent organisation to manage

Like I said I am wondering why if Sandie did say the mosque comment that noone reported it as they were obligated to do. It was a work event/work lunch and so many witnesses.

I also wonder if it was misheard or a misunderstanding given this was a restaurant, given the social media context. Maybe she was quoting it rather than saying it direct. Obviously I am Sandie's side r.e. CR so biased.

I understand why Sandie wants to come back and defend herself!

Being falsely thought of as racist, yes. Sure.

However do you really think there aren’t other white people in the NHS who think there’s too many immigrants? It’s not an uncommon view and ultimately people who think that way, aren’t going to care if others think that way.

My current management chain for example, would not investigate someone making comments like that and it’s a public sector organisation.

I think it is a very massive deal, racism is abhorrent and I would (and have had to in the past) say something to anyone spouting racist shite. In a medical setting it can be the difference between whether a patient lives or dies as shown by the maternity care for black women thread currently running.

However, I still don't believe the NHS Fife witnesses purely because their evidence has shown big moth eaten holes from the start, and each witnesses credibility has individually IMO been lacking.

I dont believe that she said this bacon through the letterbox thing at all because that is the sort of thing you would only say with people you know who agree with you so i cant see her saying it with work colleagues unless they were all saying things of that nature 🤔

Direct witness I'm afraid.

It’s unsubstantiated because no one else can back this witness up. SP could be a raging racist, which I highly doubt, but that isn’t what the basis of the tribunal is, it’s about her fundamental, lawful right to SSS. It’s also highly unlikely to be true because if FW was so pearl clutchingly outraged by it why didn’t she make an official complaint at the time? SP has an unblemished 30 year history, not a stain on her character, yet as soon as she stands up to BU she’s the worst person in the world, it makes absolutely no sense. Victoria hospital is completely ideologically captured, JR is staring down the barrel of defeat so they’ve come up with this nonsense.
