NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #44

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Oh the racism and homophobia is back.

NC has laid down the point that if Sandie loses there WILL be an appeal, and has almost laid a challenge to both the other parties that Sandie will take this the distance if they want to push the matter. Yes it lays out the seriousness to the judge but it also lays down the gauntlet to the defence in saying "well if you don't take this evidence / witness now and things don't go my way, you just give us more reason to appeal and it will merely be presented at a later date".

Given that there's been a feeling that JR has been attempting to filibuster and end the case before her flight on Thursday, its also offering a choice - get the fuck on with it, or we will resume this later in the year too.

Either way NC just pulled up with the suitcases, made herself comfortable and said "well we're here for the long haul, how about you?", which will scare the shit out of the various parties dragged into this as it puts their lives on a permenant hold. They can't escape it.

Sandie really has found a cause and has dug her heels in and is very comfortable with following through with it all to the bitter end, as have her backers.

This is not what I expected because FW has an amazingly telling video reposted on her own FB timeline of a comedian doing a routine about "How everyone is offended these days". At one point he gets a laugh for describing holding a door for someone and when accused of sexism, he says "I didn;t know you were a woman"

Ooh this is damning:
Ms Wishart says Ms Peggie and her have a “work colleague” relationship but they have socialised on a couple of occasions.
The pair were both at a lunch on 4 September 2023, shortly after Dr Upton started working at Victoria Hospital. Ms Wishart said she remembers Ms Peggie making “derogatory” remarks about Dr Upton at this lunch, but cannot remember the exact comments. She has since been told by others that Ms Peggie referred to Dr Upton as a “weirdo” and a “freak”.
Separately Ms Wishart says Ms Peggie has referred to Dr Upton as “it”.

So NHS Fife have had 18 months to attribute these rumours to ...somebody with evidence...but they just don't seem to be able to find the original source. #SadTimes
