NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #44

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.
Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

The Supreme Court has laid down that where the Equality Act 20210 refers to women, it means biological women as recorded at birth. This applies to all discrimination cases. We don’t need guidance, this is the law and always was the law.

As a court subject to the law, and the Supreme Court, it is infinitesimally unlikely that they will rule against SP, because to do so would be to go against the Supreme Court.

The TRAs know this, which is why they are screaming blue murder about it.

I know but that doesn’t mean JR and Fife, NHS Scotland and the TRAs all accept it.

What a drama! Time & momentum versus fairness and thoroughness.

I imagine the outcome of this case will ripple even beyond the UK though.

If anyone still has a spare token for Michael Foran I’d very gladly receive it.

Two very random thoughts: if Trump is receiving any briefings from his advisors re affairs on Scotland, it would be wild if he commented on this.

FB is pushing Legally Blonde clips into my reels and it dawned on me that SP is adopting the same shades of pink as Elle Woods!
