NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #44

nauticant · 25/07/2025 21:31

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.
Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

i dunno, he was a bit cozy with neil gaiman, a certified be kind creep turned mega creep

They wrote a book together, but were they 'cozy? I remember Gaiman giving that impression in interviews (especially after Pratchett died) but don't remember any gushing comments flowing the other way.

ickky · 28/07/2025 12:05

Did he say permissible?

FeedbackProvider · 28/07/2025 12:06

Is “it’s a matter for submissions” the new “that would be an ecumenical matter”?

ickky · 28/07/2025 12:06

Oh lovely. J is going to allow the witness's.

Lunde · 28/07/2025 12:07

Judge & Panel return.
J - we've got the docs,
JR have you looked at these
JR - don't object, simply object to 2 add'l witnesses
J - we consider in principle that it is permissible to call add'l witnesses in response to what R's late witnesses says. And in principle, to recall

Boiledbeetle · 28/07/2025 12:07

I've lost where this is going, I'll have to wait for a TT post

ickky · 28/07/2025 12:07

Q's to witness's must be short and sweet.

Im not getting tin foil hat about this, honest. But its not just fife who need to win this, this'll be going on throughout NHS Scotland, supported by the BMA and throuhout England and Wales.

There may be a lot of external pressure for Fife to appeal if it doesn't go their way.

I am not sure, an appeal sets a legal precedent. If Fife don’t appeal then TRAs could still claim the ruling was an aberration

GreenFriedTomato · 28/07/2025 12:08

Ha think J is having a dig at JR. States questions must be to the point and as short as possible.

So as not to waste any more bloody time 😁

Lunde · 28/07/2025 12:08

JR playing games and calling late witnesses to smear SP appears to have backfired

MarieDeGournay · 28/07/2025 12:08

MarieDeGournay · 28/07/2025 12:05

They're still not back. I've finished my ironing.
Anybody got any ironing to do?- I can pop around and do yours while we wait😄

Sorry, they're back, what a shame...😉

Boiledbeetle · 28/07/2025 12:08

Judge: going to see how things go.

In other words don't piss around

LadyBracknellsHandbagg · 28/07/2025 12:08

JR whinging again, just bloody get on with it!

mrshoho · 28/07/2025 12:08

On the basis of His Dark Materials, I'd never have thought Philip Pullman could be a be-kinder, but he is. You can't always judge a writer's moral fibre by the characters they write or the messages in their work.

Whereas JKR has the courage of Harry Potter, the humour of Ron Weasley and the intelligence of Hermione Granger in spades. She's one who genuinely lives up to ideals she writes about.

murasaki · 28/07/2025 12:09

Ah they going to start or take an early lunch?

Well done Big Sond.

That's also my impression. Gaiman in his early career was very good at befriending established authors who would give him a boost. Probably for the same reason he became a very prolific writer of blurbs for other authors' books. He was very skilled at grooming others to be character witnesses for him.

GreenFriedTomato · 28/07/2025 12:09

Fiona up now

I have two printers so my main one knows cocking up at the important times is pointless, I'll just plug the other one in. These days it mainly only has a fit of the vapours now if I've not used it for a few weeks. I guess it likes to feel needed.

I so regret buying an HP Laserjet wireless printer. It insists on being coddled and coaxed before it will print anything. Screaming, "you have ONE job", doesn't work.

Boiledbeetle · 28/07/2025 12:10

Finally!
