NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #44

nauticant · 25/07/2025 21:31

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.
Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

I'm sure after all the public money Fife has already spent on this travesty of a case they can afford to buy her a new flight. Note to JR - next time buy a fully flexible ticket....

According to NHS Fife, this case will only cost £25,000 so just put a Lear Jet and a shuttle helicopter at JR's disposal and the magic bawbee tree will tak care o it.

Re. Pratchett if he was twaw surely his daughter would have something better than 'read the books', because i have. Also I think he kept carnivorous plants. I'm sure there was something he said about them being not as interesting as you'd think.

If there is a part 3 in December. The judgement won't be out immediately. It could be months. It could be just before the elections. Either way, Sandie win or lose, it'll be a nightmare for the gender loons. Arguably it'll be worse if she loses.

Well, I haven't seen anyone knocking down Nauti's door in a rush to help. Even with the added inducement of Tunnock's chocolaty goodness.

Ha but nauti isn't bribing us with Tunnocks, we have to bribe her. And sorry but I'm not giving any of my teacakes away.

Lemonz · 28/07/2025 11:59

Just trying to catch up. At this rate I'll be playing GTA VI before we get a judgment in this case.

Sounds like there's some dynamite evidence still to come though!

Sir Pterry's daughter (who is a fully fledged handmaiden going by her social media) has been insistent for years that her dad would have been a fully paid-up Be Kind-er and to Read The Books.

She knew him, I didn't, of course. But I did Read The Books, all of them, and a certain amount of gritty 'be who you really feel you are by all means but also reality is real' was what I took from them.

Yes. I think he would very much would have been TWAW at that time in that context. We'll never know for sure, but I personally believe the man who wrote Small Gods and indeed Thud would not have been able to ignore the growing cracks in the Genderist facade since then even if he wanted to.

Am I the only one who treats an appearance by Pete like the entrance on Norm in Cheers?

🤣👍

I gave up a long time ago, just too much of a stress. I don't really print much in my personal life, and I'm lucky enough that my boss is nice enough to let me print out anything I need to at work.

I have two printers so my main one knows cocking up at the important times is pointless, I'll just plug the other one in. These days it mainly only has a fit of the vapours now if I've not used it for a few weeks. I guess it likes to feel needed.

Oh that would be a quandary, both are time suckers, you would get no sleep.

DrBlackbird · 28/07/2025 12:01

Seems I’ve missed some interesting exchanges.

Will read to catch up but going by some medical school training on equality and diversity that I’ve read this morning, I’m afraid that we’re doomed to see such incidents (in healthcare) play out over and over again . It includes training on pronouns, lectures from trans staff and students, medical students wearing pronoun badges, and positioning gender identity as primary. Apparently biological sex is included thank goodness. All part of queer pedagogy in a medical school. No wonder these soon to be doctors hold the view they do. They’ve been told to. Sigh.

Mumofteenandtween · 28/07/2025 11:58

Which witnesses said “nobody else complained”? If JR knew that others had complained (because apparently everyone knew for months!) the is she allowed to get witnesses to say that no one else minded?

JR cannot control what Fife's witnesses say. However, she cannot argue that SP was the only person to complain if she knew that was untrue.

Regarding the text from Lindsay saying what would your daughter think.

Does she not know that lesbians are women. Women who like women. Adult human females. And they too deserve privacy and dignity while changing.

I'm not sure her braincells cooperated when writing that text.

What is the ‘Benidorm chat group’? Is it likely any witness will be heard today.

On the basis of His Dark Materials, I'd never have thought Philip Pullman could be a be-kinder, but he is. You can't always judge a writer's moral fibre by the characters they write or the messages in their work.

Appeal is good as it creates precedence and is binding.

And all the courts will follow the SC ruling, because it’s the SC and the law.

Oh yes, it'd be perfect if Sandie appealed and won, because it'd be a repeat of Forstater, I believe - that's it, everyone has to follow it now. Although I do seem to remember something about it being theoretically possible for Maya's appeal to have gone to appeal, but the particular judge in her appeal had never had one overturned so ... I'd guess the take away from that is try to get your appeal heard before such a judge as His Honour Judge Choudhury.

Anyone else thinking of Bleak House - Jarndyce vs Jarndyce?
Is it normal for employment tribunals to go on for ever?

And thank Christ it’s not costing Sandie any money.
She’d be coming out in a cold sweat, otherwise.

I reckon right around now, Big Sond is questioning his life choices.

He knew he should have gone for accountancy instead. 😀

Yes, indeed. This is all quite Dickensian (see my earlier post about 'Hard Times'/'Sad Times/.

JR cannot control what Fife's witnesses say. However, she cannot argue that SP was the only person to complain if she knew that was untrue.

She did ask every single one of them (if I recall correctly) if anyone else had complained in addition to SP. Nobody forced her to do that, it was part of her strategy to make it look like SP was the only woman who had a problem with Dr Upton in the female CR.

If that strategy badoings back on her, eh I'm cool with that.

It's the whole 'an attack on trans is an attack on all the LGBTQIAKOK' bs. As if trans id males have anything to do with lesbians (apart from their claims to be one or get into the pants of one)

They're still not back. I've finished my ironing.
Anybody got any ironing to do?- I can pop around and do yours while we wait😄
