NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #44

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.
Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

NC It needs to be approached with caution and care. And in light of what JR has said about her subs including ECHR materials., It's difficult to see how the Tribunal can absorb the material and formulate questions for us based on submissions. It's not a normal case

Why on earth can't one of the legal team take a photo of the evidence they want to redact and do it in a photo edit. Failing that, take one of the bundle docs and scribble over the names.

Surely a networked office has another printer in the building!!!!!

I've been to Dundee Medical School. Well actually we got the bus up for the open day, and grabbed a prospectus in case we were asked (we weren't) then buggered off up the hill to play Laser Quest all day. Good day oot fae high school!

J - looking at the options, <missed>, it would be less a matter of legal argument then factual arguments. One way to have subs on legal background with add'l subs on the facts of the case.

If there were other objectors who spoke to any of the management witnesses saying it was only Sandie that's massive.

But anyone coming forward saying they were uncomfortable and there was a climate of fear is massive.

Blimey never a quiet day in this case.

Judge and NC trying to reach agreement...

NC - on balance I would say not that way, it's an iterative process trying to split facts from law, and would be difficult and confusing to split.
J - you may not know, do you have a timetable for remaining wits
NC - don't know we will need to take instructions afte
we have heard them, we may get one additional wit in today, possibly get through all wits with part of Wednesday morning.
J - JR anything?
JR - I don't know when NC's proposal allows for panel qs

When I was taught about safeguarding it was always you must still be suspicious as checks could just mean you havent been caught yet.

100% there are plenty of examples of trusted professions who are dbs checked have committed hideous crimes. I recall a lecture when our tutor said approximately 95% of you are sat here because you want to nurse and provide good care, the other 5% are here solely to access vulnerable groups. It sent shivers up my spine.
