NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #44

1000 replies

nauticant · 25/07/2025 21:31

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.
Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

"Would welcome recommendations, particularly anything that would work on audible as a first for 11 yr old (we have a long car journey soon)"

A good starting point for any young person would be the books featuring Tiffany Aching. This series of his starts with "The Wee Free Men" and then Hat Full of Sky, Wintersmith, I Shall Wear Midnight and The Shepherd's Crown.

Another alternative might be The Amazing Maurice and His Educated Rodents.

These are books that are specifically aimed at children.

Can I throw in a recommendation for Frances Hardinge's novels? I think dd might have been about 11 or 12 when she read them first, not sure if they are available in audible though. My favourite is A Skinfull of Shadows, dd's favourite is The Lie Tree.

oooh thank you! I was wondering where the new flow to the crowdfunder was coming from but first thought it was from X as I do more campaigning there. I've just looked at the comments and most are from MN now. Just wanted to say a huge thank you

Keep it coming - search for Faye Russell-Caldicott on crowdjustice.com.

MarieDeGournay · 28/07/2025 10:33

September, one of my concerns is whether the Tribunal itself will have the ability to absorb our subs on the legal position.
J - I have to see your subs first to be able to answer that.
NC - can we come back to you on that, establish feasibility of a day in Sept, don't want to

From TT -

'(Cont) not binary and very complicated, it's time consuming to unpick something like that'

It's a joke they're even wasting time on this, Upton is a man and DSD's have nothing to do with it.

NC is going to make JR regret allowing MC to witter on about it.

MeinKraft · 28/07/2025 10:34

JR is bound to be raging. All this time being spent on a case that SP has clearly already won anyway 😂 FAFO

Meet the Pickle Sisters—a vaudeville act from the 1920s with a flair for the unexpected. Offstage, they were Margaret, Mavis, Opal, and Florence. But under the spotlight, they went by Dillie, Kosher, Gherkin, and Cornichon. Their act, which lasted for about 15 minutes, involved songs, dances, and humorous skits centered around the theme of pickles.”

NC determined that she's going to nail this case, very clearly.

Bez.
When this tribunal is over, could you get The Fifer to organise an NHSF Heritage Trail? Local landmarks such as The Changing Room, The Weeping Doctor's Parking Space etc.

Perhaps from the top deck of an open top bus in the hospital car park? Preferably with rain for added atmosphere.

Sad Times Tours.

Loving this 😂😂😂

MarieDeGournay · 28/07/2025 10:35

J - don't want to go part heard again.
<J& Panel discussing>
J - application under rule 36 do you have comments?
NC - none
J - JR said 3,000 pages, you said 24 which is correct
NC - 24 pages
J - much more manageable
JR - 2 new witness tomorrow aft

JR objecting to a witness giving evidence via CVP

Why, it happens all the time.

anyolddinosaur · 28/07/2025 10:36

whats cvp?

Redshoeblueshoe · 28/07/2025 10:36

Can you book sick leave 5 months in advance ?

Asking for a friend

MrsOvertonsWindow · 28/07/2025 10:36

So we are seeing the consequences of JR (in the absence of facts) embarking on a smear campaign to paint SP as a loner, a racist and a bigot? Along with introducing irrelevant waffle about sex being oh so complicated that now needs legally challenging.
Well - FAFO indeed.

@Chersfrozenface Apologies I was watching it on a small screen, and idiotically wondering why it wasn't a Welsh cake. Yup I know how to make them, had a Welsh ex. Never tried any varieties.

I was musing whether chatGPT could be used for this purpose

MarieDeGournay · 28/07/2025 10:37

J - we need to look at material and consider, how long
NC - that's up to JR
JR - its 24 pages, manageable, 1 wit on group chat, 1 wit on other objections to CR.
J - we need to think about all this
JR - we object to CVP witness, all other witnesses have appeared in person

I thought JR said it was literally 3,000 pages a while ago??

GreenFriedTomato · 28/07/2025 10:37

3000 pages!!! What's in them? Hopefully screenshots that have been verified by the Scottish forensic expert as good and proper and no way tampered with like the slippery doctor
