NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #44

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.
Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

We're underway.
For Women Scotland has applied to issue a short written intervention, we heard. Jane Russell KC is making the case for this to be rejected.
Ms Peggie's legal team have also made a request to bring forward two key witnesses. Again, Ms Russell objects, adding it is very late.
Naomi Cunningham, representing Ms Peggie, is arguing NHS Fife legal team have approached this tribunal "shambolically".
She said Ms Russell should have interviewed Fiona Wishart (a witness today) much earlier in this process. Ms Russell, she said, should have anticipated that Ms Peggie would deny she held racist views and therefore would want to bring further evidence and context.
Ms Cunningham will wait to see what today's two witnesses have to say, but she wants to give Ms Peggie the opportunity to be recalled.
Two other witnesses want to give evidence on the culture at NHS Fife and the fear of speaking up.
She said Ms Russell has said that Ms Peggie was the only person to object to a "man using the changing room".
That is not so, she said.

11 am, start subs at 9 on Wednesday, resume after lunch, then Thursday at 9 am. Normally in Scotland we have submissions immediately after evidence, I would need persuading that we should do anything different.

Also The Carpet People, also a good Terry Pratchett children's book.

I'd go with the Amazing Maurice and his Educated Rodents or the The Wee Free Men as starters for children personally, they are just so good!
